A bill that William Noy owes to Jonathan Marney is filed in the amount of $86.5 3/4. The items on the list are for third rent for January 26, 1813 on house rent from Lawrence Bazadon for 6 months at $8 1/3 a month for $16.06 3/4, horse keeping eighty four days @ $.50 a day $42.00, seven months and 6 days rent for house @ $3 per month $21.62, tavern bill for $4.00, corn by bag full in ears, six bushels @ $.37 1/2 per bushel $2.25 equaling $86.55 3/4. Jonathan Marney complains of Will Noy in custody on a plea of trespass. The defendant on March 1815 at Vincennes was indebted to plaintiff in the amount of $87 for house, rent, horse keeping, corn and tavern bill. The defendant promised to faithfully repay him the amount but has failed to do so. He asks for $300 in damages. Jonathan Marney puts in his place General W. Johnston as his attorney in an action of trespass. A summons is issued to the Sheriff to bring William Noy to court the first Monday of June next. He is to answer unto Jonathan Marney on a plea of trespass and $300 in damages. R. Buntin, Clerk witnessed the document on April 15, 1815. The writ was executed by P. Almy Deputy Sheriff with the cost to serve and return being $.59. A charge of $.81 1/2 to copy court documents is also listed. G. R. C. Sullivan, attorney for William Noy states William Noy did not do as Jonathan Marney complains and puts himself upon the country and plaintiff does the like. The Sheriff of Knox County is subpoenaed on February 12, 1816 to bring Jonathan Marney before the court the first Monday of March next and give evidence against William Noy on a plea of trespass. A $100 penalty will be applied if he fails to appear. The subpoena is witnessed by R. Buntin, Clerk and executed by B. V. Beckes, Sheriff of Knox County with the cost to serve and return being $.46 1/2. Jury finds for plaintiff for $40 in damages. Foreman of the jury was Ebenezer Welton. |
