A subpoena is issued July 25, 1815, for Pierre Andre also known as Bedache and Barbary his wife. Andre and wife Barbary are currently in custody. They are to bring themselves before the judges of the Circuit Court Monday, October next. They are to answer unto John Myers and his wife Julie on a plea of trespass and slander. They are asking for damages of $5000. R Buntin, Clerk signs as witness. The subpoena is issued by B. V. Beckes, Sheriff with cost to serve being $1.09. During the October 1815 term John Myers and Julia, his wife, complain of Pierre Andre called Bedache and Barbary, his wife. John Myers states that Barbary has spread malicious and defamatory remarks of whoredom against Julie intending to defame and slander her. He also states they are trying to bring scandal on her by her neighbors in a French tongue and that John Myers, husband of Julie brings suit on damages in the amount of $5000. G. W. Johnston P. Q. is put in place by John Myers and Julie, his wife, on an action of trespass on the case for slander. A Bill of Exceptions is filed by the defendant by their council and the council moved the court for a jury de mediatate linguam (a jury consisting of 6 English speaking and 6 speaking the language of the defendant) which plaintiffs counsel opposed because the act of the territory had pointed out the manner of summoning the jury. The court ordered and granted a motion for the above jury to which opinion of the court the plaintiff accepts and prays their bill will be signed. It appears that both defendants are of the French tongue and words spoken were of that language and some witnesses where French. The bill of exceptions was signed by Justices David Raymond and J. B McCall. George Rogers Clark Sullivan, attorney for Pierre Andre called Bedache and Barbary his wife comes before the court and says that they are not guilty of the charges against them and put themselves upon the country and plaintiff by Johnson, P. Q. does the same. A subpoena for a slander plea is filed for Henriette Lefevre called Chappeau to come to court the first Monday of March next to give evidence on behalf of John and Julie Myers against Pierre Andre and Barbary, his wife, on slander. A penalty of $500 will be applied if she does not appear in court . The subpoena was signed February 12, 1816 by R. Buntin, Clerk and executed by B. V. Beckes, Sheriff with service and return listed as $.46 1/2. A summons for Henriette Lefevre also known as Chapeau is issued May 11, 1816. She is to come to court the fourth Monday of May instant, to give evidence on behalf of John Myers and Julia his wife, plaintiffs against Pierre Andre called Bedache and Barbary his wife. A $100 fine will be applied for nonappearance. The summons was executed by John Bruner, Deputy Sheriff with service and return listed as $.46. A summons date May 20, 1816 for Andre McIntire to come to court the fourth Monday of May, instant to give evidence on behalf of John Myers and Julie his wife against Pierre Andre and wife. A $100 fine will be applied for nonappearance. R. Buntin, Clerk signs and witness and the writ is executed and served by John Bruner, Deputy Sheriff with cost to serve being $.46 1/2. A summons dated June 5, 1816 and witnessed by R. Buntin, Clerk and executed by B. V. Beckes at a cost of $1.59 is issued for James Westfall, Joseph ONeil, Harriett Chappeau, and Taress Pepee. They are to come to court now at Vincennes on behalf of Pierre Andre and wife Barbary on a plea of slander. A $100 will be applied for nonappearance. A subpoena is issued June 5, 1816 by R. Buntin, Clerk and executed by B. V. Beckes, Sheriff at a cost of $.46 1/2 to serve and return for John Brady. He is to come to court this instant to give evidence on behalf of Pierre Andre and wife. A $100 penalty will be applied for nonappearance. A subpoena for James Westfall and John Brady is issued June 6, 1816 by R. Buntin, Clerk and executed by B. V. Beckes at a cost of $.84. They are to appear in court now and give evidence on behalf of Pierre Andre and wife. A $100 penalty will be applied for nonappearance. A cost of court bill is filed for July 25, 1815 to June 1816 at a cost of $30.60 1/2. |
