United States vs John Myers

Description: An indictment is filed with the jurors for the U. S. of Knox County upon their oath that there has been a common highway at Vincennes Township called the road leading to Snapp Mill. This road is used by all citizens of the U. S. as well as footmen, horsemen and carriages which all citizens have used at all times of the year without impediment. Whereas a special court was called and held at the Court House in Vincennes on the 2nd Monday in January 1815 before James McCall and Daniel Sullivan, Esquire Judges in the County of Knox John Myers of Vincennes Township was duly appointed supervisor or overseer of the highway leading from Vincennes Township to Snapp Mill. He is charged with letting the road go to disrepair and ruin so that the citizens can not use the roads to ride or use their carriages without damage against the statue of the law. The complaint is signed by William Prince, Prosecuting Attorney for Knox County. Witnesses to the complaint are William Bruce, William Carruthers, and John Elliott. A subpoena is issued to the Sheriff of Knox County to take William Bruce, John Elliott and William Carruthers to Circuit Court the first Monday of March next. They are to give evidence on behalf of the U. S. against John Myers for neglect of duty. A $100 penalty will be applied for nonappearance. Robert Buntin, Clerk signed the writ as witness on February 12, 1816. The subpoena was issued to Will Bruce, John Elliott and William Carruthers and executed by James Jordan at a cost of $1.81 1/2 for service, mileage and return. A summons to the Sheriff to take John Myers to court the first Monday of March is issued. He is to answer to an indictment for neglect of duty. A $500 penalty will be applied for failure to appear. The writ was witnessed by R. Buntin, Clerk on February 14, 1816 and executed by B. V. Beckes, Sheriff with a cost to serve and return being $.46 1/2. A cost of court bill is filed for the March to October 1815 term in the amount of $21.90. A notation by R. Buntin on May 2, 1815 states he has received his fees.
