The file contains five documents related to the suit the United States brought against James Dunkin for the assault and battery of Thomas Shepperd in 1814. Included are three subpoenas, one summons, and the Grand Jury Indictment. A subpoena was issued for William Davis to appear before the judges in Circuit Court in Vincennes on the first Monday in March to give evidence to the Grand Jury against James Dunkin and Humphry Sturman on behave of William Davis. It was issued by Robert Buntin, Clerk, CCKC on the twenty-seventh day of February 1815. It was executed and all things where in commanded by James Jordan with $1.55 1/2 fees added for serving and return. During the March Term 1815, the Prosecuting Attorney, Wm. Prince wrote an Indictment of James Dunkin of Bosseron Township a yeoman. On the thirtieth day of September 1814 with force and arms upon Thomas Shepperd in the peace of God and of the people of the United States did make an assault on Shepperd then and there did beat, wound, and ill treat him so that his life was greatly despaired of and other wrongs. On the verso side, Pled not guilty by Defendant. Also on the Indictment A true Bill Wm. Polke, foreman. Another notation from this trial, We the jurors find the Defendant guilty of the charge stated in the Indictment. James Hodgen. A summons was issued for James Dunkin to appear before the judges in Circuit Court in Vincennes to answer to an indictment for assault on Thomas Shepperd found by the Grand Jury. This was issued by Robert Buntin, Clerk CCKC on the ninth day of March 1815. It was executed by Benjamin V. Beckes, Sheriff, KC with $1.57 1/2 court fees added. Thomas Shepperd was subpoenaed to appear in Circuit Court in Vincennes the first Monday of June to give evidence on behalf of the United States against James Dunkin on an indictment of assault. This was issued by Robert Buntin, Clerk, CCKC on the eighteenth day of May 1815. Philip Almy, D.S. executed this summon with $1.78 1/2 fees added. Abraham Bogart, Catharine Bogart, Auguste Latour and Will Dunkin were also subpoenaed for the first Monday in June to give evidence on behalf of the United States against James Dunkin. The subpoenas were issued by Robert Buntin, Clerk and executed by B.V. Beckes with $2.85 fees added. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 in March 1815 it was ordered a venire do issued returnable instant. James Dunkin paid a recognizance bond with Thomas Emison as security that Dunkin would appear in court the first day of the next term. In June 1815 Dunkin appeared in court and the indictment was read to him and he pled not guilty. A jury consisted of James Hodgen (foreman), John Setser, James Hannah, Martin Rose, John Kuykendoll, Sebastian Frederick, Jr; Samuel Lane, Etheldred T. Bass, John Thickston, William Lindsay, Isaac Westfall and Joseph Woods found him guilty of the Indictment. A motion was made for a new trial and submitted without argument, it was overruled. It was ordered that Dunkin pay a fine of ten dollars, pay cost of prosecution and enter into Recognizance for good behavior until next term in fifty dollars and he stand committed until judgment be performed. Dunkin appeared in open court and acknowledged himself to be indebted to the United States for fifty dollars with Humphry Sturman acting as security for fifty dollars. The condition of the recognizance was for Dunkin to keep the peace to all people of the United States and particular Shepperd until the October Term. He appeared in court during the October Term 1815 and had another trial. The jury consisted of Richard Posey, Walter Neale, Andrew Demoze, Francois Avelin, Charles Archer, William Armstrong, Daniel Decker, Jacob Pancake, Thomas Owens, Peter Frederick, Sebastian Frederick, Nathaniel Harniss, they found him guilty. On a motion of the prosecuting attorney, it was considered that the defendant pay a fine of five dollars with costs of prosecution and stand committed until the fine and cost were paid. |
