Dubois, Toussaint vs. Ettiene Bisayon adimistrator of Francois Bisayon

Description: The file contains three documents related to the suit Toussaint Dubois brought against Ettiene Bizayon (Bisayon) the administrator of the Francois Bizayon estate to foreclose on a mortgage. One document was the mortgage contract, one a summons and one the accounting of the court costs. The mortgage/indenture signed by his mark bound Francois Bisayon (Bizayon) to Toussaint Dubois for three thousand and two hundred dollars. This document was signed on October 27, 1808 and required Bizayon to pay to Dubois four hundred ninety-six dollars on October 27, 1809; four hundred seventy-two dollars on October 27, 1810; four hundred forty-eight dollars on October 27, 1811; and four hundred twenty-four dollars on October 27, 1812. In return Bizayon received a certain dwelling or messuass and lot containing twenty-five toises (6.39 feet) in the town of Vincennes, bounding on the north east by a street, on the south east by another street, on the south west by another street and on the north west by the River Wabash together with rights members and appertaining as the said Toussaint Dubois and Jane his wife. Jonathan Jones and Will McIntosh witnessed the mortgage. Also documented Will Jones, Justice of the Peace, 27th day of October 1808 Francois Bisayon acknowledged this as a voluntary indenture. This mortgage was recorded the twenty ninth day of October 1808 in Book E pages 376, 377, and 378 by J. D. Hay, Recorder. A summons was issued for the sheriff to give notice to Ettiene Bizayon, administrator of Francois Bizayon, to appear before the judges of the Circuit Court in Vincennes the first Monday of October next to show cause why the mortgaged property should not be seized and taken in execution for payment of mortgage money, interest, and costs. This document was issued by Robert Buntin, Clerk CCKC on the 12th day of August 1815. It was executed by reading the within to the defendant in the presence of James G. Reed and Benjamin I. Harrison by B. (Benjamin) V. (Vincennes) Beckes Sheriff K C with fees of $0.46 1/2 added for service and return. The account of the court cost bill totaled $12.95 1/2. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 pages 205 and 308: October 1815 Sci Fa to foreclose on the mortgage the Plaintiff by G. (General) W. Johnston and sheriff of the county returns that by virtue of the writ of Sci Fa, read to the defendant in the presence of James G. Reed and Benjamin I. Harrison to be in court. The defendant made default. It was considered by the court that the mortgage be foreclosed and premises be sold to satisfy the debt amounting to $1840 with interest and costs.
