Hawkins, Eli ad quod damnum

Description: The file contains four documents related to Eli Hawkins ad quod damnum to build a dam and mill on Prairie Creek. In a document signed by E. Hawkins 23rd September 1813 it stated: Eli Hawkins assignee of William Hawkins who was assignee of Francois Vigo, located twenty-eight acres in right of Jean Bte. Chartick on the north side of and joining a location of four hundred acres made by Samuel Baird in right of the heirs of Samuel Brossard in Township No. 3 Range No. 7 west, being the same right formerly located by Wm. Hawkins in Township No. 3 Range No. 8 west erroneously thought them to be reserved for locations. a true copy John Badollet RLO (Prairie Creek). A second document was a writ for the sheriff to impanel twelve men to examine lands of Eli Hawkins in Hawkins township No. 3, Range Seven west to view and ascertain to the best of their skills and understanding the land proposed for the abatement of a dam for a water mill to be erected by Eli Hawkins and to examine the lands above and below the dam the property of other individuals having due regard there to the interest of each part and report to the Circuit Court to be held at Vincennes the first Monday in June next. This writ is to be executed on the third day of April next. This writ was issued by Robert Buntin, Clerk March 7, 1815. On the verso, At the time when this writ should have been executed, I went for that purpose to the White River and found the bottoms inundated and dangerous to cross until it was too late to comply with the within command. B.(Benjamin) V. Beckes Sh. K.C. A second summons was issued to impanel a jury to study and report the ad quod damnum by Robert Buntin, Clerk on the 15th day of June 1815. It was to be executed on the twenty-sixth day of June . On the verso, Purcell, William Purcell, Joseph Culbertson, Samuel Kelso, Joseph Kelso. After examining the lands the opinion was that neither lands, house, or orchard would be effected or passage or ordinary navigation would be obstructed. Signed Richard Palmer, Joseph Pitzer, Robert Bratton, Hezekiah Ragsdale, Daniel Comer, Martin Albert, George Curtis, Jesse Purcell, William Purcell, Joseph Culbertson, Saml J. Kelso, Joseph Kelso. According to the Minute Book of the Knox County Court of Common Pleas/ Circuit Court 1811-1817 pages 160 and 199: June Term 1815, the sheriff returned the writ and he could not executed due to the high water. Alias writ do issued to be executed the 25th of June next. During the October Term 1815, the report was read and documented and it was ordered that the dam and mill be established.
