Description: The file contains the documents related to the suit the United States brought against John Colbert for the assault and battery of Joseph Culbertson on the 22nd of March 1816. There are twelve documents in the file, one indictment, three summons, seven subpoenas, and the recognizance bond. William Prince presented to the Grand Jury that John Colbert of Knox County, yeoman, on the 22nd of March 1816, in and upon the body of Joseph Culbertson did make an assault, did beat bruise and ill treat so that his life was despaired of. According to Benjamin Beckes, foreman, it was a true bill. John Colbert was summonsed three times to appear in the Circuit Court in Vincennes on May 29, 1816, September 10, 1816, and January 3, 1817. During the January 3rd service of the summons, Jeremiah Lockwood took Colbert into custody and took him before John Johnson, a judge of the Supreme Court and Colbert entered into recognizance. William Peterson and Andrew Hilton were subpoenaed to appear in Circuit Court on the last Monday of September 1816 to give evidence on behalf of the United States against John Colbert. This writ was issued by Robert Buntin, Clerk on the 11th of September and executed by James Jordan, Deputy Sheriff with $2.28 fees added for service and return. Benjamin Beckes was subpoenaed to appear in court on the last Monday in September 1816 to give evidence on behalf of the United States. This writ was issued by Robert Buntin, Clerk. William Watson, Benjamin Beckes, William Wallad, and Esq. Bruce were called to appear in Circuit Court the first Monday of March to give evidence on behalf of the United States against John Colbert on the 3rd of January 1817. Daniel Comer was deputized to execute this subpoena. Joseph Culbertson, Benjamin Beckes, William Watson and Squire Bruce were again subpoenaed to testify on the 14th of February 1817. Daniel Comer was deputized by B.V. Beckes to serve. William Peterson was not found. William Wallace, William Peterson, and Andrew Hilton were subpoenaed for the last Monday of February to give evidence on behalf of the United States. Daniel Comer was again deputized to serve. In a recognizance bond document, John Colbert acknowledged to be indebted to the State of Indiana for $100.0 . John Tucker and Daniel Colbert posted bond of $50.00 each. This was to ensure that John Colbert would appear in the Circuit Court in Vincennes on the last Monday of February 1817. It was signed by the mark of John Colbert, Daniel Colbert John Tucker before John Johnson, judge of the Supreme Court the 1st day of February 1817. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817, page 262, June Term 1816, an order a venera do issued. Retbl Instanter. Page 314, October Term 1816 the Defendant was called no answer returned. On a motion of the Prosecuting Attorney it was ordered that a capias issue retble instanter and cause was continued until the next day. Page 327, the 3rd day of the October Term 1816, William Peterson and Joseph Colbert bond $50.00 each will appear in court the first day of the next term to give evidence. Page 372 the 12th day of the October Term 1816, the motion of the PA that a capias do issue against the Defendant to next term. Page 383 the 3rd day of the February Term 1817, the Defendant pleaded guilty. It was ordered a fine of $3.00 for the use and benefit of peminary (?), satisfy the cost of prosecution, and that he stand committed until fine and the cost were paid.
