During the October 1815 term jurors for the U. S. of Knox County on their oath present that in the years past and now is a common highway at the township of Busseron commonly called Upper Busseron Road. The road was located in the county of Knox for all citizens of the U. S. as well as footmen, horsemen and their carriages to pass on at all times of the year without impediment. A special court was held at Vincennes on the 2nd Monday in January 1815 before James B. McCall and Daniel Sullivan, Esquires of Knox County and Isaac McCoy and John Widner of the Township of Busseron. McCoy and Widner were duly appointed supervisors or overseers of the road aforesaid leading from Marie Creek near to Abraham Johnsons Plantation of which said appointment the Isaac and John had notice. The indictment states that the said Isaac McCoy and John Widner of the township aforesaid have permitted the said road or common highway to become out of repair and ruinous by default. By not maintaining the roads the citizens are unable to travel the roadway without damages which is against the statue of the law provided. The indictment is signed by William Prince, Prosecuting Attorney with William Bruce and William Polke signing as witnesses. A summons is issued to the Sheriff of Knox County to bring William Bruce and William Polke to court the first Monday of March on behalf of the U. S. . A $100 penalty will be applied for failure to appear. The summons is dated February 12, 1816 and is signed by R. Buntin, Clerk. The writ was executed by B. V. Beckes, Sheriff with the cost to serve being listed as $1.86. A summons to take Isaac McCoy and John Widener to court the first Monday of March to answer unto an indictment of duty is issued February 14, 1816. The writ was executed by James Jordan at a cost of $1.92. The attorney prosecuting came to court and says he will no longer prosecute the indictment. |
