United States vs John Brunner

Description: An indictment is filed against John Bruner before the jurors of the United States and the County of Knox. Who upon their oath present that where there has been for years past and now a common highway at Vincennes Township in Knox County. The road is commonly called the road leading from Vincennes to Colonel Ephraim Jordans Mill. The road has been used by all citizens as well as footmen, horsemen, and their carriages. The citizens have used it to pass and to ride their carriages at all times of the year without obstruction or impediment. Whereas at a special court called and held at the Court House in Vincennes on the second Monday in January in 1815 before James McCall and Daniel Sullivan, Esquire appointed judges for Knox County they appointed Blue Dyer as Supervisor on a corner of the highway from Vincennes to Colonel Ephraim Jordans Mill. They had appointed Dyer in the place of T. J. Weathers. The jury states that the said John Bruner of the Township in the County aforesaid has permitted the said common Highway to become out of repair and ruinous by the negligence and default of him. That the said John Bruner and the citizens of the United Stats can not go near or drive their carriages through the said way. They can not go about their necessary business without great damages and injury to the citizens passing through the said highway. The jury states that this is against the form of the statue in such provided. This is presented by William Prince, Prosecuting Attorney for Knox County. Witnesses are John Barkman and Solomon Tevebaugh. William Carruthers served as foreman The Sheriff is commanded to summon John Barkman and Solomon Tevebaugh before the Judges at Circuit Court on the first Monday of March. He is to give evidence on behalf of the United States against John Brunner on an indictment for neglect of duty. A penalty of $100 will be applied if they do not appear. The indictment is dated February 12, 1816 with R. Buntin, Clerk as witness. The indictment was executed by Beckes, Sheriff of Knox County with cost of court being $1.74. A summons is issued February 14, 1816. The Sheriff is commanded to take John Bruner to court the first Monday of March next to answer to an indictment for neglect of duty. A $500 penalty will be imposed for nonappearance. Witness to the summons was R. Buntin, Clerk. The summons was executed by B. V. Beckes, Sheriff of Knox County with $.0.46 1/2 in costs.
