An indictment is filed during the August Term 1813. The indictment is against Wrexham Ellis for battery on Fanny Dixon. The U. S. and body of the county of Knox upon their oath present that Wrexham Ellis late of the Township of Vincennes in the said county of Knox, shoe maker, in July 1813 did with force and arms assault Fanny Harrington also known as Fanny Dixon and did great damage to her. The indictment is signed by William Prince, Prosecuting Attorney for Knox County, Wrexham Ellis defends himself and states he is not guilty of the charges filed against him and puts himself before the country and the U. S. does the like. Joseph ONeil, John Henry and Margaret Mulholland are witnesses. Mrs. Hunter, John Burner, Isaac Decker, Mrs. Waller Taylor and wife of Francis Saint Juele are summoned to be witnesses for Ellis at the suit of the U. S. The summons is signed by R. Buntin and executed by B. Beckes, Sheriff. All were served except for Madame St. Juele. A subpoena is issued for Joseph ONeille, John Henry, Margrette Mulholland and Fanny Dixon. They are to be brought before the Court of Common Pleas the third Monday of November next to give evidence on behalf of the U. S. against Wrexham Ellis. Who is charged in an indictment for assault and battery on Fanny Dixon. A $100 penalty will be applied for nonappearance. The summons is dated October 25, 1813 and signed by Robert Buntin, Clerk. B. V. Beckes executed the summons with a cost of $1.63 1/2. A note states that Margaret Mulholland was not found in the bailiwick. John Bruner, Isaac Decker, wife of Francis -----, ------ Hunter, Waller Taylor are to be summoned and the clerk will issued a subpoena for the plaintiff in the above case. The order is signed by R. C. Sullivan with orders to the sheriff by R. Buntin, Clerk that the witnesses are to be summoned this day. A subpoena is issued for W. H. Dunnica to be brought to court instant. He is to give evidence on behalf of the U. S. against Wrexhem Ellis. A $100 penalty will be applied for nonappearance. R. Buntin signs as witness on November 16, 1813. The summons is executed by B. V. Beckes, Sheriff at a cost of $4.50. Joseph ONeille, William H. Dunnica, Mrs. Taylor, Mrs. Hunter, Isaac Decker John Bruner, R. Buntin are all listed by the Sheriff as being served. On a motion of the defendant to arrest the judgment on the motion of indictment is filed. He files the motion upon the grounds that no day was laid in the indictment upon which the offense was committed. The court overrules the motion of the defendant to which judgment the defendant exerts and prays that his his bill of exceptions may be signed and sealed and made a part of the record. The document is signed Luke Decker and B. Beckes. A cost of court bill is filed for the August Term 1813 to November term of $30.52. The jury finds the defendant guilty and fines him $10 plus cost. |
