The file contains the documents related to the suit Jacob Kuykendall brought against James Hall for trespass for a debt of $45.70. According to the complaint filed by Kuykendalls attorney, John Rice Jones, Hall became indebted to Kuykendall when he as an apothecary treated Hall, his wife and children. He attended the family during illnesses, delivered and provided medicine. He was suing for $45.70. Kuykendall and his lawyer, Jones, posted bond of $91.40 in order to proceed with the case. The bond document was signed by Kuykendall and Rice, before [Elihu] Stout. On April 15, 1808. Kuykendall swore before, Elihu Stout, Justice of the Peace, that James Hall owed him $45.70 and stated that James Hall had absconded. Stout ordered attachment of all of James Halls goods, chattels, land and tenements so that he would appear to court on the fourth Monday of July 1808 to answer to Kuykendalls plea of trespass. Stout also ordered a Summons for Mrs. Olive Hall as garnishee and any other person indebted to or having any effects of James Hall. On the back of the Attachment order I have attached one cupboard, two tables, five chairs, one cradle, one trunk with contents and a parcel of earthenware and summons Olive Hall and George B. Weigart to appear as guarnishees [garnishees]. John McCandless, Constable. The account ledger of James Hall to Jacob Kuykendall ran from November 25, 1803 to March 1808. Some items listed were parragoric, catharticks, opium, bottle essence, etc. The balance was $42.45 A Subpoena for John Miller was issued for him to appear in July on behalf of Kuykendall. It was written on July 23, 1808, by R [Robert] Buntin, Clerk CPKC and executed by Samuel Hayes with $1.08 fees attached. A Subpoena for Daniel Curtain was issued for him to appear in August on behalf of Kuykendall. It was written on August 4, 1808 by R [Robert] Buntin, Clerk CPKC and executed by Samuel Hayes, D. Sheriff with $.46 fees attached. According to the Minute Book of the Court of Common Pleas 1807-1810 pg. 135; George B. Waigart[Weigart] reported he had nothing of James Halls. The Defendant did not appear and made default. The jury consisted of: William Jones, John McKee, Benjamin White, Jacob Plough, Peter Kuykendall, William Stewart, Henry Ruble, John Morrison, Andrew Starnater, and John Catt. The jury found for the Plaintiff damages of $42.45 and he would recover his costs and charges. The court cost totaled $17.15 1/2. |
