Jones, Thomas vs. John Grant 1808

Description: The file contains the documents related to the suit Thomas Jones, a merchant, brought against Colonel John Grant for debt in 1808. Vincennes 13th of June 1807, James Hall wrote a note to Col. John Grant, Saline, (County in Illinois) below the mouth of the Wabash River. Please to pay unto Mr. Thomas Jones of Vincennes merchant on order One hundred and fifty dollars and seventy five cents as soon as your note to me becomes due and oblige. Witnessed by Wm Prince. On the back of the note; June 19 1807, I do acknowledge the payment of the within term agreeable to the contents of the note ... John Grant. Witnessed by Joshua Sexton. In an affidavit sworn before [Elihu] Stout, Thomas Jones swore that John Grant was indebted to him for $150.00 and more. An attachment was issued for John Grant to ensure that he appears in the Court of Common Pleas on the last Monday of July 1808 to answer to a plea of trespass by Thomas Jones with damages of $300.00. This was issued by R[Robert] Buntin Clerk, CPKC on June 1, 1808. On the back of the summons Sheriff will take bail of $150.75 for which their is an affidavit filed. The summons executed by James Crow, D. Sheriff. Appearance bail was posted by John Reburn, John Forrester and Adrian Davenport. $5.89 fees were attached. A bond document was signed by John Grant, John Reburn, John Forrester, and Adrin Davenport for appearance bond of $150.75 on June 28, 1808. John Rice Jones, the attorney for Thomas Jones filed the complaint that stated, James Hall on June 13, 1807 made a bill of exchange with Grant. This exchange indebted Grant to pay Jones. In response, the defendant by his attorney J. Johnson, stated he did not promise to pay in this manner and put himself on the mercy of the country. The Plaintiff also put himself on the mercy of the country. According to the Minute Book of the Knox County Court of Common Pleas 1807-1810, during the July Term, John Forrester entered himself as special bail and delivered the Defendant to the court. Benjamin Chambers, William McIntosh, and John Small also entered as special bail. By agreement of the Parties the cause was to be continued to the next term. The Plaintiffs attorney asked for a Dedimus do issue to take a deposition in the Illinois Territory before Isaac White, Esq. The Defendant withdrew his plea of not guilty. It was ordered that the Plaintiff recover of the Defendant $158.29 and the costs and charges related to the suit. Court costs were $20.84.
