Dubois, Toussaint [Tousaint, Toussaints] vs. Henry [Hanary] J. Mills [Meels] 1808

Description: The file contains the documents related to Toussaint Dubois suit against Henry Mills for the failure of William Mills (the father) to pay off a Promissory Note. On October 22, 1806, William Mills signed a Promissory Note; Due Tusan[Toussaint] Duboy [Dubois] or bearer thirty one dollars and twenty-five cents payable at Cristmas (Christmas )most in pork. The note was witnessed by John Oneille. On the back of the note January 20, 1807; Received complete account to be paid in lard $19.26. An account of Hanary [ Henry ] Jackson Meels [Mills] with Dubois listed the following written in French: 1806, September 12 1 pair fine cotton socks 18 livres; Quid of tobacco 9; 1807, February 16 1 pipe 4 1/2; 1 dozen sand eels 1. The total was $3.35 and added to the note of October 22 equalling $34.60. In the complained filed by Gen. W. Johnston, P.Q., the lawyer for Toussaint Dubois, he complained a pleas of Trespass for $34.50 against Henry Mills on the account of his father William Mills deceased. A summons for Henry Mills was issued to appear in the Court of Common Pleas to answer to a plea of Trespass and damages of $150.00. He needed to appear the last Monday of July 1808. The Summons was written by R [Robert] Buntin, Clerk CPKC. The Summons was executed by James Crow D. Sheriff, the tax was paid and $1.49 fees were added. According to the Minute Book of the Knox County Court of Common Pleas 1807-1810 p. 154; During the November Term 1808, The Plaintiff appeared by Gen. W. Johnston and the Defendant came not. The jury: William Gamble, James Thrailhill, Solomon Tevibaugh, Fredrick Claycomb, William Miner, John Hatten, George Miner, Isaac Miner, Thomas Melton, and Ephraim Gilmore. Jury foreman, Isaac Miner find for the Plaintiff the sum of $24.84 in damages. The Plaintiff do recover of the Defendant the damages, cost and charges from the suit. Court Cost totaled $13.76 1/2
