Sullivan, Daniel ad quod damnum 1807

Description: The file contained documents related to Daniel Sullivans petition to build a dam and mill on the Patoka River [Creek] in 1807. Daniel Sullivan gave notice to the court on October 21, 1807 that he would petition for a writ of Ad quod damnum to be issued for establishing a mill on his property on Patoka River near John Sovernes [Soverns] Ferry. The land above and below the property was owned by the United States. Copies to Mess. Baddolet, Register; N [Nathaniel] Ewing, Receiver; District Vincennes A writ of Ad. quod damnun was issued by R. [Robert] Buntin, Clerk CPKC on April 7, 1808. Twelve men were empanelled to meet on the land of Daniel Sullivan on Patoka Creek to assess what damage might occur to others property, fish passage, and obstruction of navigation if he built a dam for a mill. Samuel Hayes, [Deputy Sheriff] executed the writ for P[Parmentas] Beckes at a cost of $11.65. The Jury met on the 20th of April 1808 on Dan [Daniel] Sullivans property for an abutment of a dam. Their report stated that if the dam were no more than 12 feet above the bed of the river, no damage would be caused to others property. Navigation would be impaired, but the creek was not navigable. The Jury consisted of: Abraham Decker, John Houston, Thomas Neely, Jesse Daugherty, Josiah Shields, John Stucky, John Severn, John Cunningham, John Johnson, Ebenezer Junkins, William Musgrove, James Robb Jones.
