Kuykendall, Henry vs. John McGowen [McGowin, McGowan] 1808

Description:	The file contains the documents related to the suit Henry Kuykendall brought against John McGowen for failure to pay a debt of $67.00 in the Knox County Court of Common Pleas 1808. On July 8, 1807, John McGowen signed a Promissory note to Henry Kuykendall for $67.00. He promised to pay the sum back on or before the 4th day of April 1808. The note was witnessed by Abrm [Abraham] F. Snapp. In a Complaint written by the attorney for Henry Kuykendall, Henry Hurst, for the July Term 1808; he complained that John McGowan, in custody, had not paid back the $67.00 and planned to prosecute. A Summons was issued for John McGowan to appear at court on the last Monday of July 1808. He was to answer to the pleas of debt and damages of $100.00. R [Robert] Buntin, Clerk CPKC wrote the Summons. On the back of the Summons, bails is required. Tax paid. It was executed by Samuel Hayes, D. Sheriff. George Bathes posted appearance bail. $1.57 of fees were attached. On July 21, 1808, John McGowin and George Bathes posted $100 bond to ensure John McGowen would appear in court the last Monday in July 1808. The recognizance document was signed by McGowen and Bathes and witnessed by Samuel Hayes. According to the Minute Book of the Court of Common Pleas 1807-1810 pg. 156; during the November Term 1808; the Plaintiff appeared by his attorney, Henry Hurst, the Defendant came not. Upon a motion, it was considered that the Plaintiff do recover of George Bathes his appearance bail, the sum of $67.00 with interest from April 4, 1807 until the debt is paid and all his costs and charges about the suit.
