Minor, [Miner] George vs. James Hall 1808

Description: The file contains the documents related to the suit George Minor [Miner] brought against James Hall for Trover and Conversion. According to the complaint filed by [General W.] Johnston for George Minor, James Hall was in possession of 30 pounds of Logwood valued at $7.50; 12 hatters blocks valued at $4.00; 2 flour barrels valued at $.50; 476 raccoon and fox skins weighing 12 pounds and valued at $16.50; and 9 hat bodies valued at $18.00. Hall had fraudulently kept these possessions from Minor and he asked for $300.00 in damages. In response, James Hall by his attorney, John Johnson, pleaded not guilty. A writ of habeas corpus for James Hall was written by Henry Hurst Clerk GC [General Court] on March 21, 1808. On the back of the writ, I allow this writ let it be sealed. Henry VanderBurgh Another writ written by Henry Hurst, Clerk of the General Court, stated that James Hall was detained and in prison. The General Court was to have all have copies of all the proceedings of the Court of Common Pleas on the case of Minor vs. Hall. James Hall received a Summons to appear in court on the last Monday of July 1807 to answer to charges by George Minor. The Summons was written by R [Robert] Buntin, Clerk CPKC and executed by P [Parmentas] Beckes, Sheriff, with court fees of $.46 1/2 attached. Biddle and John McCandless were Subpoenaed to appear at court on the last Monday of November 1807. They were to give evidence on behalf of James Hall and were to bring a certain article of agreement or association between George Minor and Robert Fowler by which it will appear that Minor and Fowler were partners in the art or masterly of making hats. The Subpoena was written by R [Robert] Buntin, Clerk, CPKC and executed by Samuel Hayes, D.S. with $1.68 court fees attached. A Subpoena was issued for Robert Fowler for the last Monday of November (instant) to testify on behalf of James Hall. It was written by R[Robert] Buntin, Clerk CPKC and executed by Samuel Hayes, Deputy for P[Parmentas] Beckes Sheriff. $.70 in fees were attached. Subpoena for George Wigart, Isaac Minor and ____ Howell was issued to appear in court on the last Monday of November (instant) to testify on behalf of George Minor. It was written by R[Robert] Buntin, Clerk CPKC and executed by Samuel Hayes, Deputy for P [Parmentas] Beckes, Sheriff with $1.81 1/2 fees. A second Subpoena was issued for Wigart, Minor and Howell to appear at the March Term 1808 on behalf of Minor. It was written by R [Robert] Buntin, Clerk CPKC and executed by Samuel Hayes, D.S. with $193 1/2 fees attached. Biddle and McCandless were Subpoenaed a second time to appear at the March Term 1808. They were to bring the agreement between George Minor and Robert Fowler and to testify on behalf of James Hall. The Subpoena was written by R [Robert] Buntin Clerk CPKC and executed by Samuel Hayes D.S. and had $1.44 fees attached. Robert Fowler was Subpoenaed to appear at the March Term to testify on behalf of James Hall. R [Robert] Buntin, Clerk CPKC and Samuel Hayes, D.S. could not execute Fowler was not found. William Prince was Subpoenaed to appear at the March Term 1808 to testify for James Hall. R [Robert] Buntin, Clerk CPKC wrote the Subpoena and Samuel Hayes, D.S. executed it with $.46 1/2 fees attached. According to the Minute Book of the Knox County Court of Common Pleas 1807-1810, during the November Term 1807 both parties appeared and on a motion of the Defendant, the cause was continued to the next term. During the March Term 1808, The Defendant appeared with his attorney, John Johnson, and produced a writ of habeas corpus from a judge of the General Court and a motion was allowed. The Clerk of the Court of Common Pleas was ordered to give copies of all court proceedings to the General Court. During the November Term 1808, the parties appeared by their attorneys. The jury consisted of: William Gamble, foreman; James Thrailhill, Solomon Tevibaugh, Fredrick Claycomb, Samuel McClure, Fredrick Watson, Thomas Melton, Ephraim Gilmore, William Lindsey, George Bathes, Francis Williams, Friend Lemon. The jury found for the Plaintiff the sum of $161.50 with his costs and charges. Court of Common Pleas costs were $39.36 and $161.50 Damages. General Court fees were $40.08, attorney fees were $5.32.
