James Foreman vs Nancy Ann Clark and Sophia Clark

Description: A receipt from James Foreman that said he paid for $2.75 to R. Y. Caddington for publishing notices of partition in the Vincennes Gazette for 4 weeks dated August 9, 1842. R. Y. Caddington appears before Jonathan Collins. He swears that the publication of the partition of James Foreman against Nancy Ann Clark, widow of William a. Clark deceased signed by Jonathon Collins on July 26, 1842. A petition by James Foreman dated August 9, 1842 in which he asks that commissioners be appointed to divide the property of the late William Clark. He asks that 1/5 goes to Nancy Clark and 4/5 to himself. Nancy Clark is minor child of William Clark, deceased, and Wm R. McCord is appointed guardian. Sophia Clark is represented by Alanson G. Roberts with proof of title. Jonathan P. Case, William Denney, and George Calhound are appointed Commissioners. On August 15, 1842 Wm. R. McCord, Clerk gives oath to Jonathan P. Case and William Denney. The property described in the publication is 200 acres being on the south half of donation lot # 120 being land of which she said William A. Clark died had seized. The proprietor, James Foreman has 4/5 and Nancy Clark 1/5. On August 9, 1842 William R. McCord states before John H. Harrison, J. P. that Nancy Ann Clark knows nothing of the matter and things stated. The Commissioners report was filed August 15, 1842 and states that Sophia Clark, widow of William H. Clark is to receive 1/3 consisting of beginning at south corner of lot #120 running North 45 degrees, east 40 pole to stake, thence north 18 degrees W. 60 pole to a stake then south 80 degree West, 6 pole to a stake then 92 pole N. 6 degrees W. to the dividing line between Joseph Willis and said heirs and designated as number 1 on the plat here to attached, it being the South W part of said lot. To Nancy Ann Clark she is to receive the N. E. corner of said lot #120 and running N. 45 degrees W. 80 pole to a stake then S. 45 degree W. 80 pole to a stake in the field then sought 45 degrees east eighty poles to the dividing line between said lot and lot #119 then N. 45 degrees to the beginning estimated to contain 40 acres more or less being 1/5 part of said real estate and the remaining 4/5 are to go to James Foreman. The Commissioners fees for Jonathan P. Cox is for 3 days and William Denney 2 1/2 days plus a map are included in the report.
