Lucy Pancake vs Samuel, Charlotte, James M.. Perry L., Thadeus W., Albert B., John Coleman, Catherine Wright, Robert and Margaret McBay, Archilles and Rachel Montgomery, Margaret, William, John, Peyton, and Jacob Pancake

Description: Lucy Pancake, wife of John Pancake, deceased as of December 12, 1847 having no children and no parents, brothers or sisters, declares her interest in the estate of John Pancake. A petition for partition of land between parties named is filed by C. M. Allen, attorney for the plaintiff. The Sheriff of Pike County was ordered to issue subpoenas for Samuel, Charlotte, James M. Perry L. Thaddeus, Albert B. and John Coleman, Catherine Wright, Robert M. and Mary McBay, Archillis and Rachel Montgomery, Margaret, William, John, Peyton and Jacob Pancake. They are to appear in court the 2nd Monday of June 1848. W. R. McCord was placed as guardian over Perry L. Coleman, James M. Coleman, Thaddeus Coleman and Albert B. Coleman. He states that they know nothing of the suit. The document is filed June 14, 1848. A statement by Attorney Allen that John L. Coleman has died and interest in his part of the property is now his heirs John M. Coleman, Perry L. Coleman, Thaddeus Coleman and Albert B. Coleman and that the petitioner Lucy is entitled to 1/3rd part of tract of land and that the heirs of John L. are entitled to 1/9th of a part. Samuel and Charlotte Coleman are entitled to 1/9th in right of Charlotte, Catherine Wright is entitled to 2/9th and Margaret McBay, Rachel Montgomery, Margaret, William, Jacob and John Pancake are each entitled to 2/9th a part of Donation #169 and #170 in Town 2 N. Range 9 W. containing 282 acres and that George Calhound, John Reel, William Junkins were to be appointed Commissioners. The Commissioners report on the division of the property and submit a diagram showing the property divisions. The report was submitted September 12, 1848 by John Reel, George Calhound and William Junkins with their cost for dividing the property. William Junkins was paid $8.25, John Reel $8.25, Thomas Small $2.25 and George Calhound was paid $14.75 for their wages in dividing the property. The document was filed September 12, 1848. The Report on the division of the property was entered into court on September 12, 1848.
