Knox County court record for State of Indiana vs. James Burns, 1829

Description: Folder 3701 in Box 67 of Knox County Circuit Court records at the Knox County Public Library’s McGrady-Brockman House contains five documents in the case of State of Indiana vs. James Burns. On July 13, 1829 Jane Carey, a woman of color appeared before Justice of the Peace, Martin Robinson to report an assault and battery on Susan Gibson, a woman of color stating the James Burns was the perpetrator. On that same date Robinson issued a subpoena for James Burns. On July 15 after examining the testimony Robinson found Burns guilty and ordered that Burns give security for his appearance the next court date. He failed to comply and was ordered to be confined in Knox County Jail. Burns filed a petition to Associate Judge Richard Price claiming that Harvey Almy, Jailor of Knox County upon a mittimus issued by Martin Robinson was not warranted by law and entirely unjust. He asked for discharge from custody. On July 16, 1829 Price granted Burns his freedom. The five documents include the original complaint of Jane Carey, subpoena for Burns, statement for confinement, petition from Burns, and document showing two different dates and instructions. It remains unclear if this case was ever put before a grand jury.
