The file contains three documents related to the suit William Morrison brought against Ambroise (Ambrose) Dagene (Dagenet, Dagnay) for the failure to repay a debt of $45.58 1/2. One document is a note on the debt, one is the complaint filed, and the last document is the summons for Dagene to appear in court. The note documenting the debt stated that on November 30, 1814, Ambroise Dagene or Dagnay had a debt to Will Morrison at Vincennes to the amount of $45.58 1/2. It was signed by Wm. McIntosh for Wm. Morrison. During the March Term of the Circuit Court, General W. Johnston, P.Q. filed a complaint for William Morrison. It stated that Ambrosie Dagenet in custody, was indebted to Morrison for forty-five dollars and fifty eight cents for divers good, wares and merchandize. And although often requested, he had not repaid the debt. On the verso, Morrison put in Gen. W. Johnston as his attorney in this action of trespass. A summons was issued for the sheriff to take Ambrose Dagene into custody so that he would appear before the Judges of the Court of Common Pleas on the first Monday of March next to answer unto William Morrison in a plea of trespass. It was witnessed and signed by Robert Buntin, Clerk, CCKC on the 6th day of December 1814. On the verso, came to hand the 10th December 1814 and executed 23rd January 1815 by H. (Henry) I. Mills, DSKC. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 page 197: October Term 1815 the plaintiff appeared by G,.W. Johnston and the defendant made default. The jury consisted of Richard Posey, Thomas Owens, Charles Archer, Amos Adams, Will Clarke, Francois Avelin,Andrew Demose, Walter Beale, Jacob Pancake, Peter Frederick, Sebastian Frederick and George Bogart. The defendant came into court and confessed judgment for the sum of forty-five dollars and fifty-eight and a half cents. It was ordered that the plaintiff recover the debt, costs, and charges of the suit. |
