U S vs Nicholas Vilmare and his wife Margaret or Peggy

Description: An indictment is filed during the July 1812 Term. Jurors for the United States body of Knox County do present under oath that Nicholas Villemere of Vincennes Township in the Count of Knox and his wife Peggy on the 18th of July 1812 did harbor for the space of 1 day or more Nance a servant of color who is bound to and then does owe service to Robert Buntin of the Township of Knox. He states that the aforesaid was done without his consent which has caused great injury of the said Robert Buntin. He also states that this is in contempt of the Statue of this Territory in such case made and provided to the evil example of other delinquents in the like case and against the peace and dignity of the United States. G. W. Johnston, attorney prosecutes the pleas for Knox County. Witness for the prosecution is Robert Buntin, Fanny Curtain and William Lee. A summons is issued for the Sheriff of Knox County to take Fanny Curtain before the judges of the Common Pleas Court now in session at Vincennes. They are to give evidence on behalf of the United States. A $100 penalty will be applied if she fails to appear on the 28th of July 1812 per Robert Buntin, Clerk of the Common Pleas Court. The summons is executed by Levi Sanders who was deputized for Sheriff Crow. The Sheriff is commanded to take Nicholas Villemere and wife before the judges of the Court of Common Pleas the last Monday of November, next to answer unto a bill of indictment preferred against him at the July 1812 term. The summons was issued October 19, 1812 by R. Buntin, Clerk. A note states the defendants were not found in the bailiwick. Attorney G. W. Johnston P. Q. filed the summons. A capias indictment is filed. The Sheriff is commanded to take Nicholas Villemere and Peggy his wife to court the last Monday of March next and have them answer unto the U. S. on an indictment against them for harboring black servants contrary to the law. The summons was witnessed on December 12, 1812 by R. Buntin, Clerk and bail is required. The defendants were committed to jail per Mark Barnett bail hand. A recognize bond for Nicholas Villmere, Peggy his wife, and James Manning of Knox County Indiana Territory is filed. They are held and firmly bound unto James Crow, Sheriff in the sum of $50 on December 26, 1812. They are to appear before the judges of our Court of Common Pleas the last Monday in March next. They are to answer unto the U. S. on an indictment filed against them and James Manning. The bond is witnessed by Mark Barnett and signed by Nicholas Villemere, Peggy Villemere and James Manning. The Sheriff of Knox County is commanded to bring Robert Buntin and Fanny Curtain before the judges of the Court of Common Pleas the third Monday of March instant to give evidence on behalf of the U. S. against Nicholas Villemere and Peggy his wife on an indictment. A $100 penalty will be applied for failure to appear. The summons is dated March 9, 1813 and witnessed by R. Buntin, Clerk. The summons was executed by Mark Barnett, Sheriff. A subpoena for the Sheriff to take Louis La Liberty, St. Jule, the taylor, and Fanny Curtain before the judges of the Court of Common Pleas on the third Monday of November next is issued. They are to give evidence on behalf of the U. S. against Nicholas Villemere and Margrette his wife in a plea of indictment preferred against them. A $100 fine will be applied for nonappearance. The Subpoena is filed October 25, 1813 and executed by B. V. Beckes, Sheriff with costs to serve being $1.63 1/2. The Sheriff of Knox County is commanded to take Nicholas Villemere and wife Peggy to court the third Monday of November next. They are to answer unto the U.S. on an indictment preferred against them for harboring the servants of Robert Buntin. R. Buntin, Clerk as witness filed the summons October 25, 1813. B. V. Beckes states a copias on Nicholas Villemere who was enlisted was filed. His commander swore to his appearance. Peggy was not found. This case abates by the death of the defendant Villemere.
