A summons is issued for Walter Wilson, Esq., George Minor and John Deberre to come to court the last Monday November instant on behalf of Robert Fillpot, defendant at the suit of Joseph Decker Jr., plaintiff. A $100 file will be applied if he does not appear. The summons is dated November 27, 1809. It was witnessed by Robert Buntin, and executed by James Crow, Deputy with a cost to serve listed as $2.41 1/2. A recognizance bond for Robert Philpot and Abraham Bruner is filed. They acknowledge themselves indebted to the U. S. in the sum of $50 to be levied on their respective goods, chattels, lands and tenements if in default. The condition is that the recognizance bond was from an indictment found by the grand jury against Robert Philpot for larceny. He is to appear in court March 1810. The bond is signed by Robert Philpot and Abraham Bruner before Will Jones on November 29, 1809. During the November 1809 term Thomas Randolph Attorney General, states that the jury found that Robert Philpot did with force of arms on August 2,1809 take 2 and 3/4 yards of white cotton muslin with a value of $1.03 1/2 of goods from one Joseph Decker Jr. Michael Thorn states that the grand jury finds the within a true bill. A summons is issued by Robert Buntin on February 28, 1810. The summons is for the sheriff ordering him to take Robert Philpot to court the third Monday of March 1810 to answer unto an indictment against him for larceny. The summons is executed by James Crow Deputy Sheriff at a cost to serve being $3.46 1/2. A subpoena is issued on March 6, 1810 by R. Buntin. The subpoena is for Edward Philips, John Debery, Walter Wilson Esq. and George Minor to come to court on behalf of the U. S. against Robert Philpot, defendant. A $100 penalty will be applied for nonappearance. The subpoena was executed by James Crow, Deputy Sheriff with the cost to serve being listed at $1.36 1/2. The jury was listed as: Henry J. Mills, James Lindsay, William Lindsay, Liberty White, Francis Mallet, David Lilly, Hempstead Bennett, Abraham Bruner, Edward Phillips, John Reel, Hugh Kelly and John Bruner. The prisoner was found not guilty. |
