Jones, Thomas vs. John Grant

Description: The file contains one document, a Summons for William McIntosh, Benjamin Chambers, and John Small who posted themselves as special bond for John Grant who was sued by Thomas Jones. According to the Summons issued by R [Robert] Buntin, Clerk CCPKC, during the March Term 1809, Thomas Jones recovered against John Grant one hundred fifty-eight Dollars and ninety-seven and one half cents for his costs and charges about his suit. Judgment was given the execution of the damages and cost remain. At the July Term 1808, Benjamin Chambers, William McIntosh and John Small pledged bail for Grant and that and if Grant should be convicted at the suit of Jones, Grant would pay all damages and costs or render his body to prison in execution. If he did not, Chambers, McIntosh and Small would do it for him. And where as the damages and costs to Jones had not be paid, John Grant surrendered himself to prison. The Summons was to give notice to Chambers, McIntosh, and Small that they where to appear before the Judges of the Court of Common Pleas the third Monday in March 1812, to show why Jones should not have his execution against them for damages and cost and effect of recognizance. On the verso side Thomas Jones vs. John Grant Sci Faci agt the bail in this cause. The Summons was served by John I Neely on two persons with $1.84 added court costs for serving. Executed on the 19th March 1812 in presence of Col. John Small before Mark Barnett and Benj. Price and Wm. McIntosh in presence John Johnson and John McClure. Benj. Chambers not found John I Neely, D. Shiff. According to the Minute Book of the Knox County Court of Common Pleas, 1811-1817, page 52; During the March Term 1812, the Plaintiff appeared by John Johnson. The Defendant called three times did not appear. A motion was considered that the Plaintiff have his execution against William McIntosh, John Small and Benjamin Chambers for costs, and, damages in the suit.
