Jones, Thomas vs. Benjamin Chambers et al

Description:	The file contains two documents related to the suit Thomas Jones brought against Benjamin Chambers, John Small, and William McIntosh to recover a debt, damages and court costs that where awarded to him after his suit of John Grant in the Knox County Court of Common Pleas in 1809. The first document was a summons for Chambers, Small and McIntosh and the second was the listing of the court costs. The summons listed the details of the first suit in which Thomas Jones was awarded $158.29 of a debt, damages, and court costs. And although Jones was awarded the judgment, it had never been executed. Benjamin Chambers, William McIntosh, and John Small at the July Term in 1808 pledged bail, damages and court costs for John Grant if he was convicted. Since John Grant did not pay the judgment nor did he go to prison a writ of scire Facias was issued for Chambers, Small and McIntosh. They were to appear before the judges the 16th day of March 1812 to show why execution should not be issued against them for debt, damages, and cost according to the force form and effect of the recognizance. The sheriff gave notice to Small, and McIntosh, Chambers could not be found. At the March Term 1812, the defendants did not appear. This writ was issued by R. Buntin, Clerk CCKC on February 14, 1815 it was executed on John Small in the presence of G.W .Johnston and John Johnson also on Wm. McIntosh in the presence of Joseph Painter and John Johnson. Benjamin Chambers was not found in my bailiwick , B.(Benjamin) V. Beckes, Sheriff. The cost of serving was $0.99. The second document listed the court cost items at $9.19. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 page 171, in the June Term 1815, Sci f. to revive Judgment - the plaintiff appeared and the defendants came not.
