The file contains two documents related to the suit Thomas Jones brought against Aquilla Ramsey for failure to pay off a mortgage and his request to have the judgment executed. On March 7, 1812, R [Robert] Buntin, Clerk CCPKC, issued a Summons for Aquilla Ramsey to appear before the Judges of the Knox County Court of Common Pleas. He was to answer to why the judgement of July 1809 against him from the suit of Thomas Jones should not be executed. Jones had recovered one hundred-sixty-five dollars debt on a mortgage and twenty-three dollars ninety-two cents, one third of the account Interest, together with his court costs and charges. Ramsey was to answer to why the mortgage premises should not be sold to satisfy the debt and court costs. On the verso side of the Summons, executed 13th March 1812 John I. Neely, D. Shff. $1.90 1/2 was added as court costs for serving the Summons. The second document was an accounting of the court costs totaling $1.90 1/2. According to the Minute Book of the Knox County Court of Common Pleas 1811-1817, page 52; The Plaintiff appeared by John Johnson, the Defendant did not appear. On a motion of the Plaintiff, it was considered that the Plaintiff have his execution against the Defendant and that the mortgaged premises be sold to satisfy the debt, damages, and court costs. |
