Jones, Thomas vs. John Stork and Sebastian Frederick

Description: The file contains four documents related to the suit Thomas Jones brought against John Stork and Sebastian Frederick for the failure to pay a promissory note for ninety dollars and ninety-six cents. The documents are a promissory note, a summons, the complaint and a memorandum. On May 29, 1813, Sebastian Frederick and John Stork signed a promissory note to Thomas Jones for value received. They were to pay off the note in six months after the date signed. the note was witnessed by Fredk. Graeter. A summons was issued for the sheriff to take John Stork and Sebastian Frederick to keep them so they would appear before the judges of the Circuit Court the first Monday in March next to answer unto Thomas Jones on a plea that they render unto him the sum of ninety dollars and ninety-six cents and damages of one hundred dollars. The summons was witnessed and signed by Robert Buntin, Clerk CCKC on the twenty-seventh day of February 1815. On the verso side of the summons, This action is brought on a note under seal, Bail is required for the sum of ninety dollars and ninety-six cents. G. W. Johnston, P.Q. Executed on John Stork and John Dowling special bail, Frederick not time to serve on. Jas Jordan D.S. Service and Return $.59, Special bail bond $.65, Miles 11 $.66, Total $2.00. A Complaint was filed for Thomas Jones by (General Washington) Johnston P.Q. in the Circuit Court during the March Term 1815. It stated, Thomas Jones Complains of John Stork and Sebastian Frederick in custody, they render unto him the sum of ninety dollars and ninety-six cents. They signed a promissory note on May 29, 1813 promising to pay him ninety dollars and ninety-six cents within six months. They did not repay the thirtieth day of November 1813 and although requested, payment had not be made. During the March Term 1815 Knox County Indiana Territory a memorandum was written that on the fourth day of March 1815, John Dowing appeared before B. Beckes, Sheriff and undertook for John Stork at the suit of Thos. Jones in an action of debt for ninety dollars and ninety-six cents now defending in the Circuit Court that John Stork shall appear the first Monday in March to answer to the suit and that John Stork will pay the condemnation of the court or render his body to prison or John Dowling will do it for him. Test Jon McBain. The last document detailed the court costs which amounted to $11.41 1/2. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 page 124, during the March Term 1815, Louis Frederick appeared in court and agreed to be special bond for Sebastian Frederick. On page 174, the plaintiff appeared by his attorney and the defendants did not-they made default. It was ordered that the Plaintiff recover of the Defendants his debt with interest from the first of December 1813 until paid, together with costs and charges from the suit.
