Description: The file contains three documents related to the suit George Miner brought against William Lindsay for failure to pay a debt. On November 27, 1809 a Summons was issued for William Lindsay to appear in the Knox County Court of Common Pleas the third day of the November Term 1809. He was to answer to George Miner in a plea that he render unto him the sum of $49.00 which he owed and unjustly detained and to damages to George Miner for the use of Jacob Miner $100.00. The Summons was issued by Robert Buntin, Clerk. On the verso of the Summons; This action is brought on a note under seal therefore bail is required for the sum of $49.00. The Summons was executed by John McCandless, D. Sheriff with a court costs of $1.09. Appearance bail was posted by James Lindsay. The second document was the appearance bail posted on November 29, 1809 by William and James Lindsay. They posted $98.00 to insure that William Lindsey would appear before the Judges during the November Term 1809. The document was signed by Wm. Lindsay and James Lindsay and witnessed by John McCandless. The third document was the Complaint file by Johnston, the attorney for George Miner. It stated that George Miner Complained of William Lindsay, in custody, a plea he render unto him the sum of $50.00. The Defendant on May 31, 1809 made a promissory note and promised to pay it back on or before September 1, 1809 for the value received. He asked for $100.00 in damages. George Miner (by Jacob Miner) put in his place Gen. W. Johnston as his attorney in the suit against William Lindsay. According to the Minute Book of the Knox County Court of Common Pleas 1807 -1810, pa ge 233: During the March Term, the parties appeared by their attorneys. The Sheriff produced a Writ of Ha Cor. It was ordered that the same be allowed and that the Clerk of the Court do certify the proceedings had in this cause to the General Court.
