Harbin, John vs James Dunkin and Enock Davis

Description: A summons is issued for James Dunkin and Enoch Davis. They are to appear the last Monday of November, next, to answer unto John Harbin on a Plea of Covenant Broken with damages of $1000. The summons is witnessed by Robert Buntin, Clerk and signed October 17, 1808 with a cost to serve being listed as $2.79. The summons was executed by P. Beckes, Sheriff. James Dunkin and Enoch Davis are bound unto Permenas Beckes, Sheriff for $500.10 plus $1000 damages on November 22, 1808. They are to appear the last Monday of November to answer unto John Harbin on a Plea of Broken Covenant. The bond is signed by James Dunkin, Enoch Davis and William Hogue in the presence of John McCandless. A complaint is filed by John Harbin against Enoch Davis who is in custody in a Plea of Breach of Covenant on an agreement made February 3, 1807 at Vincennes. It was agreed that John in consideration of $90 in hand paid by James and Enoch and them owing the further sum of $500 on two different days, the first day of May next $210 plus $300 in twelve months from the date promised. After payment he was to convey to James and Enoch, 300 acres of land that was part of a tract of 400 acres granted to Joseph Hamelin Jr. by the U. S. The said Joseph Hamelin Jr. was the head of a family in Vincennes in the year 1783. This was confirmed by the Land Office District of Vincennes to the said John Harbin and Henry Vanderburg who own the hundred acres residue of the said tract as assignees. In consideration the said James Dunkin and Enoch Davis promised to pay John Harbin the sum of $510 and that John was not to execute the conveyance of the said land until all fees due were paid to him. James and Enoch took possession of that 300 acres of land but have failed to pay and John Harbin states they have broken the covenant. John Harbin puts in his place General W. Johnston as his attorney during the November Term 1808.
