Miner [Minor] Jacob and George vs. Robert Fowler et. al. 1807

Description: The file contains the law suit, Jacob and George Minor brought against Robert Fowler, James Hall, and Michael Thorn in 1807 in the Knox Court of Common Pleas. In a Complaint filed by the Plaintiffs attorney, Gen. W. Johnston, it stated that on the 7th of August, 1807; the Defendants signed in writing that they owed the Plaintiffs $34.32. Although the Plaintiffs had requested payment, they the Defendants had refused. The suit asked for the payment of $34.32 and damages of $100. The Plaintiffs pledged to prosecute and Gen. W. Johnston was assigned as their attorney. A Summons was issued for Robert Fowler, Michael Thorn and James Hall to pick them up so they would appear in court the last Monday in November to answer to the plea of Debt filed by the Miners. The Summons was issued by R [Robert], Clerk CPKC and executed by R [Robert] Buntin, Clerk CPKC. On the back of the Summons it stated bail was required--Fredrick Milch posted appearance bail. P [Parmentas] Beckes, Sheriff executed the Summons with $2.09 1/2 fees attached. On the 7 of August 1807, Robert Fowler, Michael Thorn and James Hall firmly bound themselves to Jacob and George Miner for $34.32 on the condition that this obligation was such that Robert Fowler was committed to the jail of Knox County until the debt was executed. On September 12, 1807, Recognizance bond was signed for Robert Fowler, Michael Thorn, James Hall, and appearance bail by Frederick Melch. It was witnessed by M. Kellar. A Subpoena was issued for Daniel Curtain to appear on the 3rd Monday of March to give evidence on behalf of Jacob and George Miner. It was issued by R [Robert] Buntin, Clerk CPKC and executed by Samuel Hayes, D. Sheriff with $1.46 fees attached. A Subpoena was issued for John Mills to appear at the last Monday of July 180 to testify on behalf of Jacob and George Miner. The Subpoena was issued by R [Robert ] Buntin, Clerk CPKC and executed by Samuel Hayes, D. Sheriff with $1.06 1/2 fees attached. March 31, 1808 a court order for a Deposition by John Mills was issued by R [Robert] Buntin, Clerk CPKC. John Mills stated in a Deposition, before [Elihu] Stout, that Jacob Minor came to the Hatting Shop of James Hall and told Robert Fowler that he should not expect anything if he should stay in jail. That if he would go with him to his fathers house to pay what he owed him in money or good Castor hats, his father would agree. Mills also stated that before the proceedings of court last March, George, Isaac and William Miner came into the shop with peach brandy and pressed him [John Mills] to drink and insisted upon him to say before then that he knew not of Fowler breaking the bounds of jail. The Defendants attorney, Jon [Jonathan] Jennings wrote a bond document during the March 1808 Term. Fowler, Thorn, and Hall were bound to the Miner for $34.32 on the condition that Robert Fowler now in jail, under two executions issued from Walter Wilson, Justice of the Peace, for a debt of $17.32, continue in the prison boundary until discharged. A Subpoena was issued for John Bready to testify on behalf of the Miners on August 1, 1808. It was issued by R[Robert] Buntin, Clerk and executed by Samuel Hayes D. Sheriff with fees of $0.46 1/2. Another Subpoena was issued for George Wallace, Isaac Miner, and William Miner to appear on August 1, 1808 on behalf of the Miners. It was issued by R[Robet] Buntin and executed by Samuel Hayes with $1.21 1/2 fees. Daniel Curtain received a second Subpoena to appear on July 29, on behalf of Fowler, Hall, and Thorn. According to the Knox County Minute Book of Common Pleas, the case was continued until August 2, 1808. The jury consisting of Jacob Tevebaugh, Joseph Hollingsworth, Abraham Woods, Henry Ruble, Peter Ruby (foreman), John Wallace, John McKee, Mark Dunning, John Reed, John Hatton, John Marshal, and John Duling. They found for the Plaintiff the sum of $34.32 with costs and expenses. Court Costs were $33.41.
