Gaylord G. Barton, Doctor vs Mary Bennefiel [Bennifield], Admin., with the will annexed Robert Bennefiel [Bennifield] deceased 1840

Description:	The file contains the complaint of Dr. Gaylord G. Barton, doctor and apothecary for unpaid bills of Robert Bennefiel and his family. He is suing Mary Bennefiel the Administratrix of the Robert Bennefiel Estate. The services provided by Dr. Barton are listed in detail. The complaint presented by A.T. Ellis, attorney, for the plaintiff asked for $100 in fees and $50 in damages for the debt. It was filed January 13, 1840 by N.Y. Carper, Deputy Clerk, for W.R. McCord, Clerk. The fees were from January 27, 1837-September 6, 1837 and included the following: visit and meds grandson $5.00, presc and meds self $4.00, z vi tinct Gentian $.75, presc and meds, self and vensections Mary $1.50, visits presc, meds and 2 days attendance Daniel $7.50, z iv tinct Quinine $2.00, presc, venesections and cathartic self $.75, emetic for Caleb $.25, visits presc. meds and 24 hours of attendance self $8.00, visits meds and 12 hours attendance $8.00 for the total bill of $66.25. In addition: 11 weeks boarding by Isabell Bennefiel while at Ms. Buttens school in the summer of 1837 at Two dollars per week $22.00 for a final total of $88.25. Also included in the file, one subpoena for Mary Bennefiel to be at court November Term 1839, witnessed by and signed by Willim R. McCord. A summons for Felix Cain and wife and George Wiles to be at February Term 1840 witnessed by William R. McCord and signed by N.Y. Carper, Deputy Clerk, executed by Zach Pulliam, Sheriff. A subpoena was issued for Joseph W. Briggs to be at the February Term 1840 was witnessed by William R. McCord and signed by N.Y. Carper, Deputy Clerk. Also included is a note by Ellis to the clerk and a note of the judgement being reached by the parties in favor of the Plaintiff for the sum of Fifty-four Dollars and sixty-nine cents and cost. The agreement is signed by Mary Bennefiel and Samuel Bennefiel.
