John Ockiltree vs John Small

Description: Transcript by Robert Buntin of the suit John Ockiltree brought against John Small for debt of four hundred ninety-nine dollars and damages of one hundred dollars. In the August Term 1801, a Writ of Capias was filed against John Small to answer to a plea of Debt and Damages by John Ockiltree, witnessed by James Johnson. The writ was executed by William Prince, Sheriff. At the November 1801 Term, Thomas Jourdan entered himself special bail for the Defendant. John Ockiltree was represented by his attorney, General Washington Johnson. John Small was represented by his attorney, Robert Hamilton. Ockiltree complains of John Small, in custody, of a plea render unto him the sum of four hundred ninety-nine dollars. On June 8, 1801 he received a Promissory Note from the defendant that he would pay on demand with interest. Plaintiff states he has not received payment or any part there of. The Defendant is to file his plea by and at the Rule Day on the Second Saturday in January 1802. February Term 1802, the defendant filed his plea. John Small ads John Ockiltree by his attorney, Benjamin Park. The said writing obligatory is not his deed and of this he puts himself upon the county. The case was continued until the May Term 1802. May Term 1802, appeared John Ockiltree with his attorney, General Washington Johnston and John Small with Benjamin Park and Robert Hamilton his attorneys. The sheriff of the county appeared with a Writ of Habeas corpus cum from the Judge of the General Court.
