Adhemar St. Martin vs Jean Baptiste Barsalaux

Description: Transcript by Robert Buntin, Clerk, reporting on the plea of Trespass, Adhemar St. Martin brought against Jean Baptiste Barsalaux for damages of twelve hundred dollars. May 19, 1801 a Writ of attachment was witnessed by James Johnson against Barsalaux to answer in the plea of Trespass of St. Martin. On the return by virtue of this Writ, I have attached and taken in possession one lot joining Margrette Gamelin the North, Thomas Jones on the South, a street on the East, and the Wabash on the West. No other property to my knowledge. William Prince, Sheriff. August Term 1802, St. Martin and his attorney, John A. Jones appeared, Barsalaux was a default. The suit continued to November Term 1801. St. Martin and his attorney, Jones appeared in November, Barsalaux was in default, the case continued to February Term 1802. In February, St. Martin with his attorney, John Jones filed a declaration and plea of Trespass. St. Martin said that Jean Baptiste Barsalaux on January 1, 1795 was indebted to the sum of one thousand two hundred dollars and had made promise to pay. The case was continued to the May Term 1802. At the May Term, St. Martin attended while Barsalaux was in default. Therefore it is considered that the said, St. Martin ought to recover his damages by reason of the primisses; but because it is unknown what damages the same Adhemar hath sustained by reason of the primisses, the sheriff is commanded that by the Oath of twelve good and lawful men of your bailiwick they diligently inquire what damages the said Adhemar have sustained. William Prince, Sheriff, returned to court on the inquisition taken before him at the house of James Purcell in the Town of Vincennes in the said County of Knox on Saturday the thirty-first day of July, 1802 by the oath of twelve good and lawful men of the said County it was found by reason of the primisses besides his costs and charges by him about his suit in this behalf, expended to one thousand and three hundred and fifty dollars.
