An incomplete court transcript written by Robert Buntin, Clerk, regarding plea of Trespass against John McDonald for an unpaid promissory note. The Plaintiffs are partners in the Charles Smith Vincennes Steam Company. Benjamin Parke, Nathaniel Ewing, John D. Hays, William Fellows, George Ewing, William Harlow, Wilson Lagrow were partners in the Charles Smith Vincennes Steam Mill Company. Benjamin Parke acted as the agent and Charles Smith listed as deceased. The partners brought a suit against John McDonald by their attorney, David Hart on a plea of Trespass for a sum of sixteen hundred dollars. In their Declaration, on November 28, 1821, it was stated that John McDonald had written a promissory note for value received and would pay the sum of five hundred dollars, five months after that date at Vincennes Bank, the State Bank of Indiana. He promised to pay Benjamin Parke, who was acting as an agent for the company two hundred dollars and also owed eighteen hundred and sixty dollars for goods, wares and merchandise received. A writ of capias ad respondendum was witnessed by Robert Buntin and executed on January 12, 1882 by John Decker, SKC. Charles McClure acknowledged himself as Special Bond for John McDonald. At the bottom of the transcript, it indicates that Judges Henry Ruble and William L. Colman were present. The parties by their counsels and by consent the cause was left into John Law and William Prince. |
