John Small vs Thomas Coulter

Description: The file contains the transcript written by Robert Buntin, Clerk , of the Small vs. Coulter suit. John Small filed a plea of Trespass against Thomas Coulter and asked for one thousand dollars in damages. In Smalls Declaration, he stated that during a conversation on February 1, 1800, he and Thomas Coulter discussed and agreed on the rental of Smalls house and property including tables, seats, and irons, shovels and tongs. Stable, smoke house, garden, and a field on the other side of the Wabash River opposite the house. Additionally, the use of the ferry and a flat boat. Due to Coulter not renting the property, he had to rent to James Pursley at a reduced rate. A Writ pf Capias for Thomas Coulter was issued by James Johnson on February 19, 1801 and executed by William Prince, Sheriff for the May Term 1801. Small and his attorney, General William Johnson and Thomas Coulter and his attorney, Benjamin Park appeared at the May Court while the case was continued to the August 1801 Term, then the November Term. In January 1802, Coulter filed his plea or answer to the Small Declaration. Thomas Coulter ads John Small. Coulter declaring they did not have an agreement. In the February Term 1802, John Small had a Writ of Certiorari from the Judges of the General Court and records were to be sent to the General Court.
