Johnston, General W. vs William Lintz

Description: A promissory note dated June 16, 1807, Vincennes, Indiana Territory and signed by William Lientz. He promises to pay General W. Johnston the just full sum of $70.80 five days after the date. The note was witnessed by William Prince. A receipt dated April 1, 1808 and received of Samuel Thorn in the amount of $50 in part of William Lientzs note is filed. The receipt was dated June 16, 1807 for $70.80 and payable five days from the time. George Washington Johnston states he endorsed the note. A note by Samuel Thorn states the $50 was returned to General Washington Johnson as the note was not answering the purpose intentioned, therefore credit is invalid. A Foreign attachment of debt is filed on September 26, 1808. G. W. Johnston made an oath before Luke Decker that William Lientz is justly indebted to him in the sum of $70.80 by note of hand and that William Lientz is not an inhabitant of this territory. A writ of attachment is issued September 13, 1808 by R. Buntin, who is ordered to attach all singular goods and chattels rights and credits, lands, tenements and ditaments of William Lientz and bring before him before judges in he Common Pleas the last Monday of November next to answer unto General W. Johnston on a plea of $70.80 plus $150 in damages. He is to also summoned all persons who may have goods and chattels of William Lientz to appear the last Monday of November 1808. The sheriff is ordered by G. W. Johnston to attach 2/3rds a tract of land containing 200 acres on the N. W. side of the Wabash River joining Enoch Davis and James Duncan of Knox County. Samuel Hayes Deputy Sheriff states he has attached the above described lands in the presence of Peter Jones and Elihu Stout on October 31, 1808. William Lientz is attached to answer unto General W. Johnston in a plea of debt of $70.80 The debt was made by promissory note on June 16, 1807. Johnston also asks for $150 damages. The attachment is filed September 26, 1808. On January 12, 1809 a receipt on land sold to Enoch Davis, bushels of corn sold, and interest for September 26, 1808-November 1, 1808 is filed. In March 21, 1809 an advertisement for Foreign attachment in debt against William Lientz is filed by R. Buntin in the Common Pleas Court on 200 acres of property owned by Lientz situated on the N. W. side of the Wabash is filed.
