John Small vs Luke Decker. File contains the documents relating to Smalls suit against Decker for Trover and Conversion. The complaint stated that on December 26, 1789, Small, had a Negro wench, Francis or Fanny valued at eight hundred dollars. He lost the said Negro slave out of his hands and possession, and she came into the hands of Luke Decker by finding. Yet that said, Luke, knowing that the said Negro belonged to Small, hath not delivered the said Negro wench to the said John, though often required. Small is asking for damages of twelve hundred dollars. The file contains summons for Toussaint Dubois, Christopher Wyant, John Savage and Henry Vanderburgh. Various warrants for Luke Decker, signed by Pierre Gamelin and James Baird. Writ of Error issued by John Cleves Symmes and signed by Darneille. On July 6, 1791 the parties appeared with their attorneys. The jurors were: Anthony Smyth, foreman; John Dorrith, Toussaint Dubois, Benjamin Barker, John Harbin, Joshua Harbin, James Halliday, John Westfall, Robert Mays, Fredrick Mehel, John Robbins and James Johnson. The verdict was for the defendant, Luke Decker, to recover his court cost signed by Pierre Gamelin. |
