Eustace Compagniotte vs Pierre, Marcellatte, Eulela, Oliver, Margaret and Paul Compagniotte

Description: Eustace Compagniott by his attorney R. Carnan, petitions the court to appoint Commissioners to divide a tract of land. A publication of annexed notice that appeared in the Vincennes Gazette for 4 weeks is presented on April 9, 1836 and filed before Samuel Hill, Justice of the Peace on May 10, 1836. A copy of the decree appointing Jeremiah Donevan, Jacob Harper and J. H. Bayard as Commissioners is filed. They took oath to perform their duties before Martin Robinson on May 11, 1836. On a motion in court Francis Vigo McKee is appointed as guardian of the defendant minors. The Commissioners are ordered to adjudge and determine whether the real estate of 74 acres off of the east side of west fractional section #22 Town 2 North Range 10 West lying in Knox County In. is susceptible of a division without prejudice. If divisible then 2/5 ths of the property is to go to the plaintiff and 1/10th to each of the defendants. An amendment to the decree is filed by A. D. Scott, Clerk. The amendment to the decree is filed by Attorney Carnahan and the defendants lawyer Francis Vigo McKee states there is an error in the notice and petition filed. He states the land is Range 10 W. in the petition and notice and should be Range 11 W. The amendment is filed May 12, 1836. A report of the Commissioners is filed May 11, 1840 and signed J. Donevan, Jacob Harper and J. F. Bayard. They state that the 74 acres are not susceptible to division. A Commissioners sale posted in the Vincennes Gazette 3 weeks in a row is presented and sworn to personally by R. G. Caddington in front of Jonathan Collins, Justice of the Peace on August 11, 1836. A report of the sale is filed August 10, 1836 by Jacob Harper, Jeremiah Donevan and John Bayard, Commissioners. They state that the land once belonging to the late Pierre Compagniotte was sold after giving public notice and they did on the 20th of June last expose said premises to sale by public venue at the tavern of John C. Clark in the town of Vincennes and sold the property to Eustace Compagniotte for the sum of $656.75. The commissioners state they did give him a certificate and received from him a bond payable in 12 months from the date of said purchase. Eustace Compagniotte states he received $360 from the Commissioners for the amount due to the minor heirs of Pierre Compagniotte on June 20, 1837. He also states he received $240 in the sale of the real estate for his share and also Delode Pierre, Andres wife and Hyacinth La Plantes wife whom he purchased their share prior to sale. The account is filed June 18, 1850 by M. R. McCord, Clerk.
