The account is dated August 28, 1814 to July 10, 1815. Balance due on the account is $240.00 less payment of $232.90 leaving a balance of $7.10. Items on the accounts are 17 pieces of washing $1.00 1/2, brandy, bitters, supper, cash lent, toddy, cider wine and punch. A complaint is filed by Peter Jones against Charles Tillinghast in custody for a plea of trespass. The complaint states that on September 11, 1815 at Vincennes he was indebted into the said Peter in the sum of $275 and has refused to pay so Peter Jones brings suit against him. The complaint is signed by G. R. C. Sullivan P. Q. Charles H. Tillinghast, by General W. Johnston, P. D., his attorney comes and defends the wrong and injury and says that he did not do in the manner and form that has been complained by Peter Jones. A replication is filed by Peter Jones by his attorney G. R. C. Sullivan, P. Q. on February 12, 1816 and he puts himself upon the country and the defendant does the same. The Sheriff of Knox County is ordered to summon Gideon Romine to appear in Circuit Court the 1st Monday of March next to give evidence on behalf of Peter Jones. A $100 penalty will be applied if he does not appear. The subpoena is filed February 12, 1816 by R. Buntin, Clerk and executed by B. V. Beckes at a cost of $1.46 1/2. The Sheriff of Knox Co is to subpoena Daniel Sullivan and David L. Gregg to appear before the judges of the Circuit Court held at Vincennes on the first Monday of March next. They are to give evidence on behalf of C. H. Tillinghast, defendant at the suit of Peter Jones on a case of trespass. A $100 penalty for nonappearance will be applied. The subpoena is dated February 19, 1816 and is witnessed by R. Buntin, Clerk. B. V. Beckes, Sheriff states persons were not found. Charles H. Tillinghast defendant in the case makes an oath that Daniel Sullivan and David L. Gregg are material witnesses for him the said defendant and he expects to prove a settlement with said Jones. He states that due diligence has been used to procure their attendance and that the said Daniel Sullivan and David Legg have not been in residence of this territory since the March term of this court. He believes and therefore prays a continuance of the cause and that a dedimus may be issued to take evidence . He asks for a deposition of the witnesses. This was sworn in open court in front of R. Buntin, Clerk. A summons is issued for the Sheriff to take Gideon Romine before the judges of the Circuit Court on the forth Monday of May instant. He is to give evidence on behalf of Peter Jones, plaintiff against C. H. Tillinghast defendant on a plea of trespass. A $100 penalty will be applied for nonappearance. Robert Buntin witnessed the summons on May 11, 1816 with B. V. Beckes, Sheriff executing the summons on May 31, 1816 at a cost of $4.62. A summons is issued to the Sheriff to take Daniel Sullivan and David L. Gregg to court the fourth Monday of May instant. They are to give evidence on behalf of C. H. Tillinghast, defendant on a plea of trespass. A $100 penalty will be applied for nonappearance. The summons was witnessed on May 11, 1816 by R. Buntin, Clerk. B. V. Beckes, Sheriff states that the men were not found with cost of serve being $.09. A copy of the notice by C. H. Tillinghast was given to Peter Jones. He stated to Jones that he would between the hours of 10 and 7 at the Lexington Ky. Courthouse take the deposition of David L. Gregg that is to be read in evidence at the Knox County Court which you may attend and cross examine. James Jordan, Deputy Sheriff certified that on August 19, 1816 he had delivered the notice to Peter Jones and that it was a true copy of the deposition of David Gregg. A summons is issued to the Sheriff to bring Charles Tillinghast to court the first Monday of October next to answer unto Peter Jones. A $500 penalty fee will be applied for nonappearance. R. Buntin, Clerk witnessed the summons on September 13, 1816. It was executed by B. V. Beckes, Sheriff of Knox County at a cost of $.46 1/2. C. H. Tillinghast gives notice to Peter Jones that on September 23, 1816 between the hours of 10 and 7 in Middletown, Ky. I shall proceed to take the deposition of Daniel Sullivan and it will be read as evidence in Knox County Circuit Court on an action of trespass. He also states that at that time Peter Jones may cross examine the witness. John Brunner, Deputy Sheriff states that a certified copy was delivered to Peter Jones. A cost bill was filed. The Sheriff fees were listed as $3.25, Attorney fees of $2.50, Jury fees $3.00 totaling $8.75 plus judgement fee of $9.07 3/4. The clerks fees were not included. |
