Description: A receipt is presented that was signed by Joseph Kennedy. The receipt stated that Zechariah Shicott paid him $15 for Thomas Lane on March 24, 1814. Witness to the receipt was Honor Geny. A subpoena for Joseph Kennedy, John Dubois and Elihu Stout to come before the Judges of the Circuit Court the 1st Monday of March and give evidence on behalf of Zach Chicotte is issued. They are to give evidence on behalf of Zach Chicotte on the suit of Thomas Jones. The subpoena was signed by R. Buntin, Clerk on February 12. 1816. The subpoena was executed by B. V. Beckes, Sheriff. The cost to serve being $1.69. A Scire Facias is issued to the Sheriff of Knox County. Whereas Thomas Jones came before the Judges of the Common Pleas March 19, 1810 and by judgment of that court recovered against Zachariah Shicott $253.26 for damages. These judgments which he sustained as well by reason of nonperformance of certain promises and assumptions by him (Zachariah) to Thomas Jones. Also for his costs and charges made by him about his suit in their behalf expended. Zachariah is convicted on record and judgment remains unpaid, and Thomas seeks his remedy. The court demands the Sheriff to bring Zachariah Shicott before the Judges of the Circuit Court on the 1st Monday of March next. He is to say why he has not paid for his execution and damages charged against him. Robert Buntin signs as witness on February 14, 1815. The Sheriff of Knox County is to summon Joseph Kennedy, John Dowlin and Elihu Stout to come before the Circuit Court the 4th Monday of may instant. They are to give evidence on behalf of Zach Chicotte, defendant at the suit of Thomas Jones, plaintiff. A $100 penalty will be applied for nonappearance. The summons was dated May 11, 1816 and witness by R. Buntin, Clerk. B. V. Beckes states Joseph Kennedy was not found. Cost to serve, mileage of 8 miles and returnable is listed as $1.32 is filed. The U. S. to the Sheriff of Knox County whereas Thomas Jones by judgment was to recover on March 19, 1810 $253.26 for damages. Zachariah Chicot has failed to pay even the judgment that was given and the debt remains unpaid. The court commands the Sheriff to have Zachariah Shicott before the Judges of the Circuit Court the 1st Monday of October next for debt, damages and costs. He is to have the names of men who gave notice to Zachariah. The subpoena is witnessed June 16, 1815 by R. Buntin and executed by B. V. Beckes by reading the writ to the defendant. The subpoena was read before Antoine ONeil and Honor Genie. The cost to serve being $1.46 1/2. A plea for an appeal was filed by Zachariah Chicottes attorney General W. Johnston. His attorney comes and says that the judgment of said Thomas as afore thought was not to be received for the original amount. He also states nor ought the said Thomas to have execution thereon against him as he has paid to the agent of Thomas $100 as of March 24,1814 and $15 to John Kennedy on taxes for Thomas Joness property in Warrick County and is ready to verify payments. The document is signed by Johnston P. Q. during the October 1815 term. A replication for Thomas Jones was filed by John Johnson his attorney who comes before the court and says that he ought not to be barred or precluded from having his judgment reversed against the said Zachariah has not paid the said debt in manner and form as stated per J. Johnson attorney for Jones. A subpoena was issued for Frederick Graeter and William Prince to give evidence on behalf of Thomas Jones, plaintiff and Zachariah Shicott, defendant on behalf of Thomas Jones, plaintiff and Zachariah Shicott, defendant on a plea of Scire Facias to revive judgment. The document was witnessed and signed by R. Buntin, Clerk on June 6, 1816. B. V. Beckes, Sheriff filed a cost to serve and return bill for $1.84.
