Haff, Abraham vs William F Thompson

Description: A Scire Facias returnable during the August term of 1812 is filed. The Scire Facias is to show cause why judgment shouldnt go as issued. The issue is for the installments now due on his bond upon which there is a judgment in part in the said Court of Common Pleas. The judgment is agreeably to the Statue of Law of the Territory. The Scire Facias is signed July 31, 1813 by G. W. Johnston P. Q. and issued by Robert Buntin, Esq. Clerk for the Court of Common Pleas of Knox County. A summons from the U. S. to the Sheriff of Knox County is issued. He is to bring Abraham Haff before the judges of the Court of Common Pleas at Vincennes in our said county at the July Term of 1812. By the judgment of our same court received against William F. Thompson the sum of $182.51 in damages together with the sum for costs, interests, and extra damages determined in the General Court are due. This judgment being the balance of 2 installments that are due on a writing obligatory entered into by the said William F. Thompson with the said Abram Haff. One installment of $100 is now due and owing on the writing obligatory and others to become due. We therefore command the Sheriff that by good and lawful men you give notice to William F. Thompson that he appear before our judges in our Court of Common Pleas at Vincennes the third Monday of August instant and show why judgment should not be entered against him for the sum of $100. The Sheriff is also to have the names of those by whom he has given William Thompson notice with this writ. The document was witnessed by Robert Buntin, Clerk on August 5, 1813, and G. W. Johnston P. Q., Sheriff B. Beckes, states that William F. Thompson was not found within the bailiwick. An Alias Scire Facias is filed with the Sheriff of Knox County. It states that whereas Abraham Haff came before the judges of the Court of Common Plea at Vincennes during the July Term of 1812 by writ of the judgment of our same court recovered against William F. Thompson the sum of $182.51 in damages together with the sum of his costs, interests and extra damage. The judgment is on the case heard by the General Court being the balance of two installments due on a writing obligation entered into by the said William F. Thompson with the said Abraham Haff. There is now 1 installment of $100 due and others pending we therefore command you that by good and lawful men of your bailiwick you, the Sheriff, give notice to the said William F. Thompson that he is to appear before the judges in the Court of Common Pleas to be held at Vincennes in our county on the third Monday of November next. He is to say before the judges why judgment should not be entered against him for the said sum of $100. The Sheriff is also to have the names of those by whom you shall give him notice. The writ was witnessed by Robert Buntin, Clerk on October 25, 1813. B. Beckes, Sheriff, states that William F. Thompson was not found. The cost bill on the Scire Facias from August 1813-November 1813 is $11.38.
