The file contains ten documents relating to the suit the United States brought against Thomas Shepherd(Shepperd, Shepard) James Cowan, Joseph Cowan, John Cowan, Joel Cowan, Ruth Cowan,Elizabeth Sheperd, and Esther Cowan for rioting and disturbing the peace. On October 6, 1814, James Dunkin swore in an affidavit before Judge James B. McCall that Thomas Shepard, James Cowan, Joseph Cowan, John Cowan, Joel Cowan and Ruth Cowan several times during the month of September and especially the sixteenth of September beat and shot at him with intentions of killing him and they have threatened to injure him, his family, and destroy his property. On October 6, 1814, Judge J.B. McCall issued warrants for Thomas Shepard, James Cowan, Joseph Cowan, John Cowan, Ruth Cowan and Esther Cowan to appear before him to get sureties of the peace and good behavior toward James Dunkin and all other good citizens until the next sitting of the Circuit Court. The warrants were executed by P (Phillip) Almy on October 9, 1814 with a court cost billing of the writs $3.50; 6 def 20 miles $4.80; 1 def 18 miles $0.72. On October 11, 1814, before Judge J.B. McCall, Thomas Shepard, Joseph Cowan, Joel Cowan, John Cowan, and Ruth Cowan acknowledged themselves indebted to the United States in the sum of two hundred dollars each and John McClure in the sum of one thousand dollars. The condition of this recognizance was that they would keep the peace and do no hurt or injury to the good people of the United States and more particularly toward James Dunkin and family, and they would appear at the next term of the Circuit Court. Summons were issued for the defendants to appear before the judges in the Circuit Court to be held at Vincennes the first Monday of March next to answer to their recognizance of October 11, 1814. This writ was issued and signed by Robert Buntin, Clerk, on February 18, 1815. The writ was executed on all except John and Joseph by James Jordan. Attached court fees totaled $3.41. During the March Term 1815, a subpoena was issued for James Dunkin to give evidence to the Grand Jury by R. Buntin Clerk. It was executed by B.V. Beckes with fees of $0.46 1/2. During the March Term 1815, the Grand Jury for the United States and the body of the county presented that Thomas Shepherd of the township of Busseron, yeoman; John Cowan, yeoman late of the same; Joel Cowan, yeoman; James Cowan, yeoman; James Cowan, yeoman; Elizabeth Shephard, spinster; Esther Cowan, spinster; on the thirtieth day of September in the year 1814 in Busseron Township did unlawfully riotously and assault and gathered together to disturb the peace of the people of the United Stated to the evil example of all others in like cases offending against the peace and dignity of the United States, signed W. Prince, Prosecuting Attorney Knox County. On the verso side of the indictment , A true Bill Wm. Polke, foreman. James Dunica prosecutor and plea not guilty. Also noted on the side of this Indictment, Not guilty. Danl McClure foreman. On March 9th, 1815 summons were issued for the Defendants to appear before the Judges of the Circuit Court at Vincennes to answer to an Indictment for rioting and disturbing the peace. The summons was witnessed and issued by Robert Buntin, Clerk, CCKC. It was executed by a former precpt in my hands same time since and returned, B.V. Beckes. Subpoenas were issued for James Strain, Catherine Strain, and Polly Williams to be at the Circuit Court at Vincennes on the first Monday of June to give evidence on behalf of Thomas Shepherd and others defendants at the suit of the United States in a plea of rioting. This subpoena was witnessed and issued by Robert Buntin, Clerk CCKC on May 17, 1815. On the verso side of this writ, executed in all things herein commanded. P. Almy D.S. with $2.53 1/2 fees for serving. The Defendants were again summonsed to appear before the Judges of the Circuit Court the first Monday in June next to answer to an indictment for rioting and disturbing the peace. This summons was written by Robert Buntin, Clerk CCKC on May 18, 1815 and executed by P. Almy, D.S. with $4.93 1/2 attached fees. James Dunkin was subpoenaed to appear in the Circuit Court the first Monday of June to give evidence on behalf of the United States against Thomas Shepherd and others in an Indictment of rioting. This subpoena was issued by R. Buntin, Clerk on May 18, 1815 and executed by P. Almy , D.S. with $1.66 1/2 court fees added. |
