Badger, William vs. Nancy Badger

Description: The file contains five documents related to the petition for divorce filed by William Badger against Nancy Badger. In a Petition for divorce filed by William Badger, he stated that on the 26th day of December 1805 he and Nancy Jacks were joined in the Holy Estate of Matrimony. They lived together for four years during which time they had one child. About the year 1809 Nancy voluntarily deserted his bed and board and had lived in adultery with another man in the State of Kentucky and he could prove this. He asked the court to grant him a divorce. Also noted on the Petition, March Term order of court and advertisement. A court order was signed by Robert Buntin, Clerk and W. Prince the attorney for the Plaintiff, that stated, William Badger vs. Nancy Badger in this cause the Complainant having filed his petition praying to be divorced from the bans of Matrimony with said Nancy and it appearing to the satisfaction of the court that Nancy is not a resident within the Territory, it is therefore considered by the court that unless Nancy shall appear at the next term of our Circuit Court and answer the petition that the same will be taken as confessed and a decree accordingly and that this order to be published for eight weeks in some public newspaper in this Territory. The third document was Subpoenas for William Everman and Elias Newkirk to appear before the judges of the Circuit Court to be held the first Monday in June next. They were to give evidence on behalf of William Badger against Nancy Badger for a divorce. This writ was witnessed and signed by Robert Buntin Clerk CCKC on the 21st day of April 1815. Philip Almay, D.S. executed the writ with attached fees of: Service on 2 $0.75; miles 13 @ .06 $0.78; return $0.09; Total $1.62. The forth document was the Divorce Decree. Satisfactory proof having been made as required by law the court grants the Petition in this case and decrees that the Complainant be divorced from Bans of Matrimony. Test Robert Buntin, Clerk CCKC. Copy. The account sheet for the court costs totaled $5.06 1/2 and $1.71. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 pages 144, 156, and 158. On page 144 March 1815: In this case the Complainant having filed his petition asked to be divorced from the Bans of Matrimony with Nancy and to the satisfaction of court, Nancy is not a resident within this Territory it is therefore considered by the court that unless Nancy shall appear at the next term of our circuit court and answer petition that the same will be taken as confessed and decreed accordingly and this order published for eight weeks in some public newspaper in the Territory. On page 156 June 1815: Libel for Divorce. William Everman and Elias Newkirk were sworn in and gave evidence, the cause was continued. Page 158: Satisfactory proof having been made as required by law the court grants the Petition and Decree that the Complainant be divorced from bans of matrimony with his wife Nancy.
