The file contains fourteen documents regarding the suit of a plea of trespass quare clausm fregit that James Dunkin brought against Thomas Shepherd, Elizabeth his wife, James Cowan, Joel Cowan, Ruth Cowan, and Esa (Esther) Cowan. Included one summons, one complaint, a plea of not guilty, nine subpoenas, a petition for a change of venue and one affidavit. Thomas Shepherd, James Cowan, Ruth Cowan, and Esa (Esther) Cowan were summonsed to appear before the judges in the Circuit Court of Vincennes the first Monday of March to answer unto James Dunkin of a plea of trespass and quare claus fregit and damages of five hundred dollars. This writ was witnessed and issued by Robert Buntin, Clerk the first of December 1814 and was executed by B.V. Beckes, Sheriff KC with $4.39 court fees added. During the March Term 1815, George R.C. Sullivan, attorney, filed a complaint for James Dunkin against Thomas and his wife Elizabeth Shepherd, James and his wife Rachel Cowan, Joel Cowan, Ruth Cowan, and Esa alias Esther Cowan in a plea of trespass quare clausm fregit. The complaint stated that defendants with force and arms remained and continued in and on the plaintiffs farm on Busseron Creek in Busseron Township from the first day of September 1814 until the fourteenth day of September 1814. They deprived him of the profit and benefit of the plaintiffs grass, corn, wheat, oats, and herbage valued at three dollars and removed a well bucket valued at Five dollars. The defendants took down the fence and gates and allowed their horses, cows, sheep and swine to trod down, destroy, and consume the grain and crops of the enclosed farm. Dunkin asked for five hundred dollars in damages and put in George R.C. Sullivan as his attorney in this suit. In a note by J. Johnson, the attorney for the defendants, they plead not guilty and put themselves on the country. Auguste Latour was subpoenaed three times to appear in the Circuit Court in Vincennes. He was to appear on behalf of John Cowan on the first Monday of March 1815; to appear on behalf of James Dunkin on the first Monday in June and the first Monday in October 1815. Mary (Polly) Williams was subpoena four times to appear in the Circuit Court on the behalf of the defendants, twice on the first Monday in March, once on the 18th of June, and once the first Monday in October. Henry Williams the husband of Mary Williams was subpoenaed to appear in the Circuit Court on behalf of John Cowan on the firs Monday of March 1815. Kitty Strane and James Strane were subpoenaed three times to appear in Circuit Court on behalf of Thomas Shepherd on first Monday of March, the 18th of June, and the first Monday of October. Abraham Bogart was subpoenaed twice to the Circuit Court to appear on behalf of James Dunkin on the first Monday in June 1815 and the 20th of June 1815. William Dunkin was subpoenaed twice to the Circuit Court to appear on behalf of James Dunkin on the first Monday in June 1815 and the first Monday of October. John Martin was subpoenaed three time to Circuit Court to appear on behalf of Thomas Shepherd on the eighth of June 1815, and twice on the first Monday of October. The thirteenth document dated Vincennes 5th October 1815, was a petition of James Dunkin to have case moved from Knox County to Gibson County. The last document was a affidavit by James Dunkin that he could not get a fair trail in Knox County. |
