The file contains the documents related to the suit Joseph Huffman brought against Esther an indentured servant of Laurence Bazadone for slander, he asked for five hundred dollars in damages. A Summons was issued for Esther the indentured servant of Laurence Bazadon to keep her so that she would appear before the Judges of the Court of Common Pleas on the last Monday of July 1812. She was to answer unto Joseph Huffman in a pleas of trespass on the case of slander to damages of five hundred dollars. The Summons was issued by R [Robert] Buntin, Clerk CCPKC on March 27th 1812 and executed by James Crow, Sheriff with $.59 added for serving the Summons. During the July Term 1812, a Complaint was filed by Gen. Johnston for Joseph Hoffman. The Complaint stated that Esther, an Indentured Servant of Laurient Bazadone, in custody, in a plea of trespass on a case of slander. According to the document, Esther, contriving maliciously and wickedly intending to injure, defame and slander, depriving Hoffman, of his good name by speech, uttered in the presence and hearing of citizens that he stole Morris, the preachers great coat, a piece of handkerchief of Antoine Lassalle, and a camp kettle from the soldiers. He asked for damages of five hundred dollars. Joseph Hoffman put in his place Gen. W. Johnston as his attorney in this action of slander. Also noted on the document, we of the jury find damages for the Plaintiff six dollars sixty-six and two thirds cents. J.B. Drinner Samuel Parr, John Moore, Collette Mayette and Antoine Gamelin were issued Subpoenas to appear in the court of Common Pleas the last Monday in November next. They were to give evidence on behalf of Joseph Huffman, plaintiff against Esther [Bazadone], a Negro woman. These Subpoenas were issued by R Buntin, Clerk on October 20, 1812 and executed by Mark Barnett with $1.62 1/2 court cost added. Subpoenas were issued for Mordi, a Negro man, and Jesse, a Negro man, to appear in the court of Common Pleas the last Monday, Instant to give evidence on behalf of Joseph Huffman. The Subpoenas were issued by R Buntin, Clerk on November 14, 1812 and executed by Mark Barnett, D. Sheriff with $.84 court costs added. Henry Busherville and Fillis, a Negro woman, were also Subpoenaed to appear and testify on behalf of Hoffman at the November Term. Buntin issued the Subpoenas and Barnett executed them with $.37 1/2 court costs. The sixth document was an account of the court costs totaling $16.72 2/3 for the November 1812 Term. According to the Minute Book of the Knox County Court of Common Pleas 1811-1817, page 68; The Plaintiff appeared by Gen. W. Johnston, his attorney; the Defendant by Henry Hurst. The Jury: John B. Drinner, James Westfall, William Cristman, James Cayl, Thomas Fasset, Thomas McClain, John Duling, Samuel Hogg, John Bruner, Thomas Westfall, Jacob Pankake, and William Bailey found for the Plaintiff six dollars and sixty-six and two-thirds cents in damages John B. Drinner, foreman. It was considered that the Plaintiff recover from the Defendant the damages aforesaid with costs and expenses from the suit. |
