The file contains the documents related to the suit David Snyder brought against Robert Adams for the failure to pay off a Promissory Note. On August 7th 1810, Robert Adams signed a Promissory Note to David Snyder for three hundred dollars for value received. The note was to be pay on or before May 1, 1811 and witnessed by Peter Jones and Will Jones. A second Promissory Note was signed on August 1, 1810 for forty-pounds, eleven shillings, and five pence for value received. It was to be paid on or before December 25, 1810 and witnessed by Noah Purcell and Sarah Purcell. An Affidavit was sworn before Wm. Prince, JPKC by David Snyder on December 29, 1810. It stated that Robert Adams was indebted to David Snyder for the sum on one hundred-thirty five dollars and twenty-five cents and Robert Adams was not an inhabitant of the Territory. December 29, 1810, H. Hurst wrote to Mr. [Robert]Buntin will issue a foreign attachment for debt of L 49 11.5 [$165.23 2/3] returnable the fourth Monday next month. On the verso side of the document, Writ issued 29th December 1810, tax not paid An Attachment Order was issued by R. Buntin, Clerk, CPKC on December 29, 1810. It commanded the Sheriff to attach all singular goods and chattels rights credits, lands and tenements and hereditments of Robert Adams and keep them safely and have ready before the Judges in the Court of Common Pleas to be held the first Monday of January next to answer unto David Snyder in a plea that he render unto him the sum of one hundred and sixty-five dollars and twenty-five cents which he owes and unjustly detained to the damage of one hundred dollars. You summons those person in whose possession you may find such goods, chattels, rights, credits, lands tenements and hereditments so that they might appear before the Judges of our court on the first Monday of January next as garnishees or to answer unto David Snyder. A Memorandum of Property attached in the hands of David Snyder: one grind stone, three cows, two calves, two steers, Iron wedge, Dutch oven, a parcel of wheat, flax, one flax brake, two kettles, one sickle, three tubs, two kegs, three hows [hoes?], one pot, three augers, one hand saw, two chisels, one drawing knife one, one chest and table, one stone crock, two small crocks, one churn, two buckets, six plates, three dishes, four Beasons, one coffee mill, two pot racks, one oven, one lantern, one pair of sheep shears, nine chairs, three bedsteads, and cords, one hackle, twenty-two knives and forks, two flat irons one looking glasses, one curry comb, one sith [?], thirty-three logs one mare and colt, padlock quantity of corn. During the November Term 1812, of the Court of Common Pleas, H. Hurst, P.Q. filed for Robert Adams a Complaint against David Snyder. The complaint stated that David Snyder made a Promissory Note promising to pay to David Snyder three hundred dollars on or before the first day of May 1811, for value received and although requested, the debt had not been paid. A second Complaint was filed during the November Term, stating that David Snyder complained Adams signed a Promissory Note to David Snyder on August 11, 1810 and promised to pay on or before December 25 the full sum of forty-pounds, eleven shillings and five pence equal to one hundred thirty-five dollars and twenty-four cents for value received. Although request for payment had been made it had not been repaid. One court cost account listed $29.42 from November 1810 to November 181. Mr. Snyder wanted the amount of the sale of Robert Adams property sold Shff McClandless to give credit on the execution for that amount. The last document listed the court cost from August 1811 to November 1811 as $12.83. According to the Minute Book of the Knox County Court of Common Pleas and Circuit Court 1811- 1817, pages 69, 130, 133, 176 and 205: Wed. December 2nd the Plaintiff appeared by Henry Hurst his attorney The Defendant made default. It was considered that the Plaintiff recover of the Defendant the sum of three hundred dollars with interest from the first day of May 1811 together with his cosst and charges. Joseph Alton appeared in court and entered himself bail in the cause in the sum of ___as is by law directed. March Term 1815 Attachment: The Plaintiff appeared by John Johnson, the Defendant did not appear. James Crow the garnishee appeared in Open Court and said he had forty-two dollars and fifty cents the property of the Defendant. Therefore it was considered the Plaintiff recover of the Defendant the sum of three hundred thirty-three dollars and fifty cents the amount of his debt and interest with cost and charges of the suit and the Plaintiff recover of the garnishee the sum of forty-two dollars and fifty cents. The Plaintiff appeared in Open Court and acknowledged satisfaction for the sum of forty-two dollars and fifty cents. |
