In the Indictment filed during the July Term 1811 and written by Thomas Randolph, Attorney General IT, the Grand Jury presented that Marie Louise Derozier (alias dichus) Pepee, spinster, on July 10, 1811 with force and at the town of Vincennes in and upon one Anna Marney, spinster, in peace of God then and there being did make and assault Anna Marney then and there did beat, wound and ill treat so that her life was greatly despaired of and other wrongs to the said Anna Marney. On the verso side, Subpoena Mrs. Anna Marney in behalf of the United States Returnable the next Common Pleas August 6, 1811. Randolph Atty Gen. Carrothers, F.The sheriff was summons to have Marie Terrise Derozier called Pepee at court December 16, 1811 to answer to the United States on Indictment for assault and battery on Anna Marney. It was issued by R [Robert] Buntin, Clerk CPKC on December 2, 1811 and executed by John I Neely, D. Sh. with court cost of $.37 1/2 for serving. A subpoena was issued for Anna Marney to appear in court to give evidence for the United States against Marie Terrese Derozier called Pepee in a plea of assault and battery. The Subpoena was issued by R. Buntin on December 2, 1811 and executed by John I. Neely on December 11, 1811 with charges of $.79 1/2. Marie Terrese Derozier called Pepee was summonsed to court the third Monday in March 1812. She was to answer unto the United States of a plea of assault and battery on the body of Anna Marney. This document was issued by R. Buntin and executed by John I. Neely with $.59 added as court cost. Anney Marney was Subpoenaed to give evidence on behalf of the United States against Marie Terrise Derozier for assault and battery. The Subpoena was issued by R. Buntin on March 7, 1812 and executed by John I. Neely, D. Sheriff with $.86 1/2 added for serving. The accounting of the court costs totaled $18.50. According to the Minute Book of the Knox County Court of Common Pleas 1811 -1817, pages 13, 35, 37, and 44; the suit was continue into the March Term 1812. The Defendant appeared by Henry Hurst, her lawyer and filed a pleas of not guilty. The jury consisted of: William Carruthers, Hugh Kelly, Levi Elliott, James Watson, Daniel Jennings, Thomas Walker, Joseph Mecum, David Willikins, John Reel, William Johnson, Benjamin Palmer, and George Anthis. The Defendant was found guilty. It was ordered that the Defendant pay a fine of $.25 and pay costs of prosecution and that she stand committed until the fine and costs were paid. |
