United States vs. Jonathan Marney 1812

Description: The file contains the Indictment of Jonathan Marney for the assault and battery of Marie Therese (Louise) Derozier called Pepee (Peepee, Pepea) and eight summons or subpoenas. During the July Term 1811, Thomas Randolph, Attorney General I. T.; wrote the Grand Jurors present that Jonathan Marney, yeoman, on the twentieth day of July 1811, with force and arms at the Town of Vincennes upon Marie Louise Derozier (Dichis); called Pepee, spinster, in the peace of God then and being did make an assault did beat wound and ill treat so that did a great damage to the evil example of all others in like case of offending against the peace and dignity of the United States. On the verso side of the Indictment, and the said Defendant, Jonathan Marney comes and says he is not guilty in manner and form as in above indictment. Subpoena Mm Pepee and John Caldwell in behalf of the U.S. Returnable to next Common Pleas August 6, 1811. Thomas Randolph, Attorney General A true bill. We of the Jury find the Defendant guilty. W. Carruthers, foreman. Mm. Pepea and John Caldwell were Subpoenaed to appear in the Court of Common Pleas. They were to give evidence to the Grand Jury on behalf of the United States against Jonathan Marney in a plea of indictment. The Subpoena was issued by R [Robert Buntin], Clerk, CPKC on August 6, 1811. The Subpoena was executed by C [Christian] Graeter, D. Sheriff. On December 2, 1811 R. Buntin, issued another Subpoena for Mm. Pepea and John Caldwell. They were to give evidence on December 16, 1811 on behalf of the United States, Plaintiff, against Jonathan Marney. This Subpoena was executed by John I. Neely, D. Sheriff with court costs of $.62 1/2 for serving. A Summons was issued for the sheriff to have Jonathan Marney so he would appear on December 16, 1811 at the Court of Common Pleas. He was to answer to the United States in a plea of Indictment for assault and battery on Maria Teresa Derozier called Pepee. This Summons was issued by R. Buntin and executed by John I. Neely, D.Shff with a cost of $.79 1/2 for serving. John Caldwell was again Subpoenaed to appear in Court December 23, 1811 on behalf of the United States against Jonathan Marney. This Subpoena was issued by R. Buntin and executed by Jones. George Conner was Subpoenaed to appear at Court on December 30, 1811 to testify on behalf of Jonathan Marney. This Subpoena was issued by R. Buntin December 25, 1811 and executed by John I Neely, December 25, 1811 with costs of $.37 1/2 for serving. A Summons was issued for the sheriff to take Jonathan Marney so that he would appear at court on the third Monday of March 1812 to answer to a plea of assault and battery on the body of Marie Terrise Derozier called Pepee. This Summons was issued by R. Buntin and executed by John I. Neely, D. Sheriff with $.59 added for court costs. Mm. Pepea and John Caldwell were again Subpoenaed. they were to appear at court on the third Monday of March 1812, and testify on behalf of the United States against Jonathan Marney in an indictment of assault and battery. This writ was issued by R. Buntin and executed by John I. Neely D. Sheriff with a cost of $.84 added for serving. According to the Minute Book of the Knox County Court of Common Pleas, 1811 - 1817 pages 13, 29, 35, 37 43, and 44; the cause was continued until the March Term 1812. At the March Term, the Defendant appeared by John Johnson and filed his pleas of not guilty. The jury consisted of: William Carruthers, Hugh Kelly, Levi Elliot, James Watson, Danniel Jennings, John Reel, William Johnson, Benjamin Palmer, Francis Anthis, Thomas Walker, Joseph Meccum and David Willkins. The jury found the defendant guilt. The Defendant asked for a new trial it was denied. It was ordered that the defendant be fined $.25 and he stand committed until the fine and the court costs were paid. The fine was paid in court to Gen. W. Johnston. While this suit was occurring, Marie Therese Derozier was indicted for assault and battery on Anna Marney, and she was found guilty.
