The file contains documents related to the law suit Thomas Jones brought against Jonathan Holmes the administrator of Andrew Holmes estate for failure to deliver about 25 gallons of whiskey out of an order for 1000 gallons of whiskey. According to the Complaint filed by John Rice Jones for Thomas Jones, on October 19, 1795 at Pittsburgh to wit Vincennes, Thomas Jones and Andrew Holmes discussed the sale of whiskey to be delivered to Frankfort, Kentucky on the first of January 1807. 1,000 gallons of whiskey were to be delivered to Jones at a cost of a half a dollar per gallon. Jones paid Holmes $500 but only 974 gallons and three quarts of whiskey were delivered. The complaint stated, although requested, the remaining whiskey was not delivered by Andrew Holmes in his life time, nor by Jonathan Holmes. A plea of trespass was to be filed that Holmes became indebted to Jones on October 1, 1799 for the sum of $100. On the Complaint, Thomas Jones put John Rice Jones in as his attorney against Jonathan Holmes administrator of Andrew Holmes in a plea of trespass. A Summons was issued for Jonathan Holmes, admin. of Andrew Holmes estate to appear the first Tuesday in August 1805. The Summons was issued by R [Robert] Buntin, Prothonotary, witnessed by Able Westfall on May 5, 1805 and reissued on June 13, 1809. It was executed by Abraham Defrance, D. Sheriff 13th June 1805. According to the Minute Book of the Knox County Court of Common Pleas pages 37, 57, 76, and 268; July Term 1807 the Plaintiff by his attorney, J.R. Jones, made a motion to continue the suit until the next term. During the November Term 1807 the suit was again continued. During the March Term 1808, a motion was ordered that a deposition be taken of witnesses in Jefferson County Kentucky returnable the next term. At the November term 1810, the Plaintiff by John Johnson by motion of his attorney asked the suit be abated by the death of the Defendant. |
