Description: The file contains the documents related to the suit David Price, the assignee of William Patterson, brought against William Lindsey to receive the execution of a Judgment granted to Patterson during the March Term 1807. A Summons was issued for William Lindsey on July 24, 1810 to appear in the Court of Common Pleas the last Monday of July 1810. He was to answer to David Price as to why Price ought not to have the execution of a Judgment delivered during the March Term of 1807 for $149.27 1/2 damages together with $11.80 1/2 for costs and charges totaling $161.08. The Summons was issued by R [Robert] Buntin, Clerk CPKC. The Summons was executed in the presence of William Mohan and Robert Buntin, Jr. on July 28, 1810 by John McCandless, Sheriff, KC. J. Johnson, attorney, filed an appeal of the judgment for William Lindsey. Johnston, P. Q. for Price filled for a Demurer asking for execution of the original judgment. The Defendants response by H. Hurst stated the judgment ought not be received and he had fully paid Judgment he prayed for judgment. The Plaintiff also asked for judgment. On July 28, 1810 a Subpoena was issued for Gen. W. Johnston, Benjamin D. Price Esqus. to appear in court on the last Monday in July, 1810 to testify on behalf of William Lindsey. The Subpoena was issued by R [Robert], Clerk and executed on Gen. W. Johnston and John Johnson. John McCandless, Sheriff, wrote Benjamin D. Price was not found. The court cost bill for the suit was $12.39 1/2. According to the Minute Book of the Knox County Court of Common Pleas pages 257 and 267, during the July Term 1810, a plea, scire facisa for judgment and demurrer were filed. The judgment on the demurrer was sustained. On a motion, the Defendant asked for a continuation of the suit for the want of a material witness. The suit was continued to the November Term. The Plaintiff was represented by Gen. W. Johnston and the Defendant by John Johnson during the November Term. It was ordered that the Plaintiff have execution of the Judgment and cost executed.
