David, Moses vs. William Henry Harrison et. al. administrators of John Francis Hamtramck estate

Description: The file contains two documents related to the suit Moses Davis brought against the administrators of Jean Francis Hamtramcks estate. A Summons was issued for William Henry Harrison and Jesse B. Thomas and Rebecca his wife the administrators for Jean Francis Hamtramcks estate. They were to appear in the Knox County Court of Common Pleas the third day of March 1807 to answer to a plea of trespass for the sum of $100.00. The Summons was issued by R [Robert] Buntin, Clerk, CPKC. On the verso side, Tax paid. I will appear for the Defendants. J [John] R [Rice ] Jones. The Subpoena was executed by P [Parmenas] Beckes, Sheriff with $.46 1/2 court fees added. In the complaint filed by Gen. W. Johnston, the attorney for Moses David, it stated he intended to sue the administrators of the Jean Francis Hamtramck estate. William Henry Harrison was an administrator and Jesse B. Thomas in the right of his wife Rebecca who was formerly Rebecca Hamtramck the widow of Jean Francis Hamtramck. They were to answer to a plea of trespass on the debt incurred by Hamtramck on September 1801 at Sandwich. On that date, Hamtramck promised to pay David $27.12 1/2 for goods and wares and mechanizes received. David was asking $100.00 in damages. On the verso side, Moses David put in Gen. W. Johnston as his lawyer in this suit. According to the Minute Book for the Knox County Court of Common Pleas 1807-1810 pages 39, 60, 81, 144, 176, and 206; the case was continued from July Term 1807- the July Term 1809. The Plaintiff asked for the continuations to get depositions. During the July Term 1809, the Plaintiff once again asked for a continuation. The court ordered that the Plaintiff receive nothing from the suit and the Defendants recover their court costs and charges.
